to Summon twelve men of his ballywick to enquire what goods and Chatties
Lands or tenements Thomas Macnemara and John Mitchell of the City of
Annapolis and parish of St Anns in the County abovesaid Gentlemen had on
the thirteenth day of July last past or at any time after wee the Jurors Sub-
scribed do make our return as followeth Vizt upon Information that one
Steven Wright is indebted to the said Macknemara the Sume of four hun-
dred pounds of tobacco and that Hezekiah Lincicomb is indebted to the said
Macknemara the Sume of four hundred and Eighty pounds of tobaccoe which
said Debt is all upon A Strict enquirey and information that wee can find
of the abovesaid Gentlemens estates If these be so deemed and so wee say all
and give it under our hands and seales this 16th day of September 1710

In Testimony Whereof the Seale of the Provinciall Court is hereunto

Afterwards on the Twelfth day of May in the twelfth Year of her Maj-
estys Reigne etc. Annoque Domini One thousand Seaven hundred and Thir-
teen before her Majestys President of her Councill of Maryland and the same
Councill sitting in A Court for hearing Appeals and Writts of Error at the
City of Annapolis afd [241] came the aforesaid Thomas Macnemara in his
owne proper person and saith that in the Record and process aforesaid as
also in the rendring of Judgment aforesaid it is manifestly erred in this (that
is to say) where Judgment is rendred that the said Thomas Machemara
should be burnt in the hand the Judgment should have been given or ren-
dred that he should be discharged And this he is ready to Verifye wherefore
for that Wm Bladen Esqr Attorney Generall of our said Lady the Queen is
here present in Court he prays the said Court may proceed to Examine the
Errors in the Record and process aforesaid and in rendring the Judgment
aforesaid and that the Judgment aforesaid for the Errors aforesaid and
others in the Record and process being be reversed Anulled and altogeather
held for naught and that the said Wm Bladen Attorney Generall aforesaid
to the Errors aforesaid may rejoyne
propria persona
And the said William Bladen her Majestys said Attorney Generall who
for her said Majesty in this behalf prosecuteth being present here in Court
saith that neither in the Record and process aforesaid nor in the rendring of
