law were Comitted or to either of them have not rendred but have hitherto
denied And the said James Edmondson Son and heir at Law doth still deny
to the damage of the said Hugh Hall Administra- as aforesaid of One hun-
dred pounds Sterling And thereof he bringeth his Suite, And he bring-
eth into Court the writing aforesd which testifieth the debt aforesaid in
forme aforesaid the date whereof is the day and Year aforesaid he bringeth
also into Court the Letters of Administration aforesaid by Which it may
appeare etc.
And the said James by Robert Gouldesborough his Attorney comes and
defends the force and injury when etc. and prayeth hearing of the Writing
aforesaid and it is read unto him he prayeth alsoe the hearing of the Con-
dition of The same Writing and it is read unto him in these Words The
Condition of this Obligation is such that if the above bounden John Ed-
mondson his heires Executors Admrs or Assignes do well and truly pay or
cause to be paid unto the above named Hugh Hall his Executors Adminis-
trators or Assignes or to his certain Attorney at or in the now dwelling house
of the said Hugh Hall in the Town calld St Michaells in the said Island of
Berbadoes [218] the full and Just Summe of One Hundred Twenty and
one pounds Sterling money at or upon the five and Twentieth day of
October next following the date of this Obligation without any manner of
fraud or further delay then this Obligation to be void and of none Effect
or els to be and remaine in full force Strength and Virtue.
And the said James Edmondson by his said Attorney cometh and De-
fendeth further the force and Injury when etc. and prayeth liberty to Im-
parle hereunto untill next Court and it is granted unto him the same day
is given the plantiff alsoe At Which said next Provinciall Court to witt the
fourteenth day of October in the Thirteenth Year of his Majestys Reigne
etc. Annoque 1701 Came the said partys by their Attorneys aforesaid and
the said James Edmondson by his said Attorney saith that there has been
divers and Sundry payments made by the said John Edmondson in his life
time to the said Hall for and toward Satisfaction of the debt aforesaid Which
cannot be Ascertained unless the Accounts between the said party's be first
Audited and Stated therefore prays an order for Auditors may Issue for that
purpose which was by the Court here granted and Orderd that Commission
Issue to Mr Solomon Wright and Mr Phillip Lynes to Audite State and Ex-
amine the Accounts between the said Hall and Edmondson and to make
their report to this Court on the morrow being the fifteenth day of October
instant which Comission Accordingly Issued. Now here at this day to witt
the Fifteenth day of October aforesaid came the said partys by their Attor-
neys Aforesaid and the Auditors aforesaid likewise came to Court and made
report of their Audite under their hands and Seals as follows Vizt
1689 Jno Edmondson of Talbot County deceas'd appears to be Debtor to
Mr Hugh Hall of the Island of Berbadoes as followeth
