i32 MARYLAND COURT OF APPEALS

Merchant was Sumond to answer unto Hugh Hall Admr of all and singular
the goods chatties rights and Creditts of Hugh Hall his father deceased of A
plea that he render unto him the said Hugh the Summe of two hundred
Forty two pounds sterling which he oweth him and Unjustly deteyneth.

And Whereupon the said Hugh by William Dent his Attorney saith
that the said John Edmondson in his life time whose son and heir the said
James Edmondson is that is to say the eldest son of the said John Edmondson
lawfully begotten and borne in Marriage the twenty fifth day of Aprill, in
the Year of our Lord one thousand Six hundred Eighty nine at Berbadoes
that is to say at the port of Annapolis in Ann Arundll County by his certain
Writing obligatory with the said John Edmondsons seale signed Acknowl-
edgd himself to be bound to the said Hugh Hall the father deceased in the
Summe of Two hundred Forty two pounds Sterling to be paid to the said
Hugh Hall when he the said John Edmondson should be thereunto required.
To the Which payment well and truly to be made the said John Edmondson
bound himself and his heirs firmly by the said Writing obligatory neverthe-
less the said John Edmondson in his life time and the said James Edmonsdon
the son and heir at law of the said John after his death the said Sume of Two
hundred forty two pounds sterling to the said Hugh Hall the father or to the
said Hugh Hall the son after his death to whom Administration of all and
singuler the goods and chatties rights and Creditts of the said Hugh Hall
after his death in due forme of law was Commited or to either of them have
not rendred but have hitherto denyed And the said James Edmondson Son
and heir at Law doth still deny to the damage of the said Hugh Hall Admr
as Aforesaid of One hundred pounds Sterling and thereof he bringeth his
Suite And he bringeth into Court the Writing Aforesaid Which testifieth
the debt aforesd in forme Aforesaid the date Whereof is the day and year
aforesaid And he bringeth here into Court alsoe the letters of Administra-
tion aforesaid by Which it may appear etc.

And the said James by Robert Gouldesborough his [196] Attorney
comes and defends the force and Injury when etc. and prayeth hearing of the
Aforesaid and it is read unto him he prayeth Alsoe the hearing of the Con-
dition of the Same writing and it is read unto him in these Words The Con-
dition of this obligation is such that if the Above bound John Edmondson
his heirs Executors or Administrators or Assignes do well and truly pay or
write to be paid unto the above named Hugh Hall his Executors Adminis-
trators or Assignes or to his certaine Attorney at or in the now dwelling house
of the said Hugh Hall in the Town called St Michael in the said Island of
Barbadoes the full and just Sume of One hundred twenty and one pounds
sterling money at or upon the five and twentieth day of October next follow-
ing the date hereof without any manner of fraud or further delay Then this
obligation to be voyd and of none effect or els to be and remain in full force
Strength and Virtue; And the said James Edmondson by his said Attorney
