According to Act of Assembly and the defendant in mercy etc.

In the Records of the Provinciall Court amongst other things is thus
contained As follows Vizt

MARYLAND ss Att A Court of her Sacred Majesty Queen Ann of Eng-
land etc. held at Annapolis in the County of Ann Arundell for the province
of Maryland this tenth day of October in the Third Yeare of the reigne of
her said Majesty etc. Annoque Domini 1704

Were present: Thos Smithson Esqr chief Justice; The Honorbl Phillip Hos-
kins; Samll Young; Seth Biggs; Thos Smith; Seth Biggs [sic], Esqrs Justices

William Round agt William Macklure

Command was given to the Sheriff of Ann Arundell County that he
should Attatch any the goods chatties or Creditts of Willm Macklure late of
Somersett County if they should be found in his Ballywick to the Vallue of
two hundred and twelve pounds Nineteen shillings and A half penny Ster-
ling money of England and of Fifteen thousand pounds of tobaccoe and
When he had the same attached or any part thereof the same in his custody
to keep so that he should have the same before the Justices of her Majesty's
Provinciall Court to be at Annapolis the Second tuesday in October next
then and there to be condemned to and for the use of Willm Round untill
the said Wm Macklure by himself or Attorney shall come and appear and
answer vnto [177] the said William Round in A plea of trespass on the case
and that by good and lawfull men of his Ballywick he should make knowne
to the party or partys in whose hands he should should [sic] make the same
Attachment that he she or they should be and appear before the Justices
aforesaid at the day and place to shew cause (if any) why the Same should
not be condemnd in his her or their hands And for the uses above men-
tiond According to Act of Assembly etc. if to him or them it should Seem
meet hereof he was not to faile at his perrill and to have then there that
Writt Witness Thoms Smithson Esqr chief Justice etc. the 21th day of May
in the third Yeare of her Majesty's reigne etc. Annoque Dmi 1704.

On the Second tuesday of October aforesaid Vizt this tenth day of Octo-
ber Aforesaid 1704 comes the Sherriff of Ann Arundell County and makes
returne that he has Attached in the hands of John Edgar of Somerset County
to the Vallue within mentiond And that he has made knowne to the said
John Edgar that he be and appear etc. before Thomas Freeborne and An-
drew Welply two good and lawfull men of his ballywick as by the Writt
required

Whereupon the said John Edgar tho' Solemnly calld to shew cause etc.
