CHAP.
XVIII.
Owners proving
Property
to be reimbursed.
Proviso, as to
Owners of
old Tobacco
giving Notice,
&c.
Old Tobacco
so Listed not
a legal Tender.
Duration. |
shall cause the same to be sold at the Time aforesaid, at Public Vendue,
in
single Hogsheads, and the Produce thereof shall be applied to the defraying
the County Charge. And whenever thereafter the Owner or Owners
of such
Tobacco, shall claim the same, or any Part thereof, and make his, her,
or
their Property appear, to the satisfaction of the said Justices, then
the said
Justices shall assess, in the next County Levy, such Sum as such Tobacco
Sold for, for the Use of the said Owner or Owners.
CLI. Provided
always, That if any Owner or Owners of any Hogshead
or Hogsheads of Tobacco, which shall be returned in such List, shall,
within
Two Months next before the said Court of Sale, give Notice in Writing
to
the Inspector or Inspectors of the Warehouse in which such Tobacco
lies,
of their being Owner or Owners thereof, describing in the said Notice
the
Mark, Number and Nett Weight of such Tobacco, and that they are unwilling
the same should be Sold, such Notice or Notices shall be by the said
Inspector
or Inspectors, returned and lodged with the said List, and such Tobacco
shall be marked, Not to be Sold, in the Copy before directed
to be set
up, nor shall the same be sold; any thing herein before contained to
the contrary
notwithstanding.
CLII. And provided
also, That no old Tobacco Listed as aforesaid, shall,
after it is so Listed, be deemed, taken, or allowed to be a legal Tender
in
any tobacco Payment whatever; any thing herein contained to the contrary
notwithstanding.
CLIII. This Act to continue until the first Day of
December which shall
be in the Year of our Lord, One Thousand Seven Hundred and Sixty-six,
and no longer.

An ACT to enable the Rector, Vestry-men, and Church-wardens of the
Parish of St. Margaret's Westminster, in
Anne-Arundel County, for the
Time being, to sell a Tract of Land therein mentioned,
and to apply the
Produce Money arising by such Sale, towards the Purchase
of another
Piece of Land to be made a Glebe, for the Use of the
Incumbent of that
Parish, and his Successors. Lib. H.S.

N.B. By this Act, (1.)
The Vestry-men and Church-wardens of the said Parish, are enabled
to sell and convey in Fee-simple, a tract or Parcel of Glebe-Land
(originally granted to a
certain William Fuller for 150 Acres, and now commonly called Whitehall)
to the highest Bidder,
not under 300 l. Sterling for the aforesaid Tract, within 12 Months
from the End of
this present Session, at public Vendue, giving Two Months Notice of the
said Sale, in the
MARYLAND GAZETTE: And to apply the produce Money towards the
purchase of another
Piece of Land, lying in some more Centrical Part of the said Parish, to
be made over to
the Vestry-men and Church-wardens aforesaid, in Trust, and for the Use
and Benefit of the
Incumbent of the said Parish, and his Successors for ever. (2.)
In case the said Vestry-men,
&c. shall not, in Six Months after such Sale, be able to purchase some
other Tract
more Centrical, as before directed; then, they shall Place the Money (arising
from such Sale)
out to Interest, upon good Security: Which Interest shall be yearly
paid to the Rector or Incumbent
for the Time being, until the Purchase as aforesaid can be made; which
it is hereby
declared to be the Duty of the said Vestry-men, &c. to make, as soon
as they possibly can, to
the Advantage and Convenience hereby intended, &c.
