CHAP.
XIII.
Gift of Slaves
to be under
Hand and
Seal, acknowledged
and
recorded.
Proviso, as to
actual Delivery,
or Bequest. |
II. Be it Enacted,
by the Right Honourable the Lord Proprietary, by and
with the Advice and Consent of his Lordship's Governor, and the Upper and
Lower
Houses of Assembly, and the Authority of the same, That from
and after the
End of this Session of Assembly, no Negro, or other Slave, whereof the
Donor shall retain the use and Possession, shall pass, alter or change,
or any
Property thereof be transferred to any Donee, unless the Gift be by Writing
under the Hand and Seal of the Donor, and acknowledged before One Provincial
Justice, or One Justice of the County where the Donor shall reside,
and Recorded in the Records of the same County within Twenty Days from
the Time of the Execution thereof.
III. Provided
always, and it is the true Intent and Meaning of this Act,
That nothing herein contained, shall extend, or be construed to extend,
to
make void any Parol Gift of any Negro, or other Slave, where there shall
be an express Delivery of such Slave, in pursuance of such Gift, and where
the sole Use and Possession of the same shall be transferred to the Donee;
nor
to make void any Bequest of any Negro, or other Slave, by any Last Will
and Testament.

An Act to aid the Proceedings of the Vestry of St. Stephen's
Parish, in Cæcil

N.B. The
Small-Pox raging in the Neighbourhood, so as to prevent the election of
Vestry-men
and Church-wardens on Easter Monday 1760; This Act makes good and valid
all the Proceedings
of the Vestry-men and Church-wardens of the said Parish, since the said
Easter Monday
1760; as if the Election of new Vestry-men, &c. had been actually made
on the Easter Monday
aforesaid, the said Omission notwithstanding.

A Supplementary ACT to an Act, entitled, h An
Act for Erecting a County
School in Worcester County, and appointing Visitors
for the same. Lib. H.S.

N.B. The
Funds of the said School being insufficient for purchasing 100, or more,
Acres of
Land, pursuant to the Directions of the Act of 1723, ch. 19; This
Act, (1.) Impowers and directs
the Visitors, with all convenient Speed, to purchase Four Lots in Snow-hill
Town, to them
and their Successors for ever, for the Use of the said School; and thereon
to cause a Public
School for the said County to be erected and built, &c. (2.)
And whereas, at the Time of
Erecting Worcester County, by the Division of Somerset County,
there was a considerable Sum in
the Hands of the Visitors of Somerset County School, they are hereby
made accountable to, and
ordered to pay to, the Visitors of Worcester County School, one
Moiety of the Money which was
in their Hands at the Time of the Division aforesaid of Somerset County:
And the Visitors of
Worcester County School, are impowered to demand and receive from
the Visitors of Somerset
County School, the said Moiety, for the Use of Worcester County
School; and in case of Refusal,
to Sue the Visitors of Somerset County School, to account for and
pay the said Moiety, &c. But
the Visitors of Somerset County School, shall not be answerable
for the same out of their own
private Monies or Estates; but it shall be paid, or (if necessary) levied
out of the Monies belonging
to Somerset County School, now in the Hands of the Visitors, or
the Treasurers, or
which shall hereafter come to their, or any of their, Hands. (3.)
There being at the Time of
the Division of Somerset County, in the Hands of James Hollyday,
Esq; deceased, late Treasurer
of the Eastern Shore, sundry Sums of Money due to Somerset County
School, the Visitors of
Worcester County School, are impowered and directed to receive from
James Hollyday, Esq; Executor
of the said James Hollyday, deceased, the one Moiety of all such
Sums, which at the Time
of the Division of Somerset County, were in the Hands of the said
late Treasurer due to Somerset
County School, &c.
