72 "Journal of the Council"

Ordered that the western Shore Treasurer pay to the Revd. Mr. Higginbothom Fifty
four pounds, five shillings and two pence due him per Account passed by the Auditor.

In Council January 9th. 1790

Whereas it appears by two transcripts from the Records of Baltimore County Court
that George Walker of Baltimore town, was fined on two presentments in the Court of Oyer
and Terminer for said County at November term last, the Sum of five pounds on each, for
keeping a disorderly house, the said George Walker represents by his Petition that the said
fines are too severe for him to bear and prays a remission thereof, And three of the Justices
of the said Court having recommended him to the clemency of Government, and it also ap-
pearing from a recommendation signed by a number of respectable inhabitants of Baltimore
town that during their knowledge of him, six years, he behaved himself with so much Industry,
Sobriety, honesty and peaceable demeanor that he rendered himself respected by his employers
and esteemed by all who knew him and that he is encumbered with a helpless family: The
Board in consideration of all the Circumstances, do direct that of each of the aforesaid fines,
four pounds ten shillings be remitted on Condition that he pays the Costs accruing thereon.

[p. 134] In Council January 9th. 1790

By the Petition of Barney Ford and Thomas Cole junr., of Baltimore County it is
represented that they were present at a quarrel between Thomas Barney and Nicholas Gill,
which ended in a fight, during which Barney bit off part of Gill's nose, the consequence of
which was a prosecution in the Criminal Court of the said County, when Barney was
fined fifteen pounds and the Petitioner Ford ten pounds, that the two Petitioners became
Securities for Barney's fine, and Barney and Cole for Ford's fine, immediately after which
Barney absconded, and was pursued without effect by the Petitioner Ford as far as the
Ohio River. The Petitioners represent that they are poor men with families of small Chil-
dren, That they live on poor land that Cole lost his house &ca. by fire last Winter, and
that the payment of the fines would occasion their Ruin. The Petition is accompanied by a
Court transcript of the proceeding. The Board on full consideration of all the Circumstances
do direct that of the above fines two thirds of each amounting to the Sum of Sixteen pounds
thirteen shillings and four pence be remitted.

On the petition of George D. Barkley of Baltimore town Setting forth that he is a native
of Germany, and being of no trade, for the support of himself and family, was induced to sit up
a Billiard table, that he (being heretofore a foreigner unacquainted with the Laws and Customs
of Maryland) apprehended he was at liberty to sell to his Customers at the table liquors as they
required, that he accordingly Sold liquors to be drank in his house in Small quantities and never
