232 "Journal of the Council"

The Counsel having concluded their observations respecting the election in Charles
County for Sheriffs.

The Council adjourned 'till tomorrow morning 9 o'clock.

Wednesday 2d. November 1791

The Council met.

Present as on yesterday.

The Question was taken "that a new election for Sheriffs in Charles County be ordered
agreeably to the prayer of the Petition" determined in the Negative and Commission issued
to James Simms the Sheriff elect as Sheriff of Charles County.

The Board then proceeded to tax the Costs arising on the aforesaid examination when it
was determined that the three Petitioners and the Sheriff, should pay the Same in equal
proportions—and that each of the Witnesses be allowed four Days itenerant charges.

Ordered that the western shore Treasurer pay to Randolph B. Latimer Fifty pounds
for one quarter's Salary as a member of the Council[,]

Ordered that the western shore Treasurer pay to John Gwinn one hundred and fifty one
pounds, two shillings and nine pence Current Money due him for the balance of an Account
proved and lodged in the Auditors Office.

Mr. John Shaw is requested to make such repairs to the windows and fire places in the
house of Delegates as are necessary and to procure tables, benches, Curtains to two windows,
coverings for the tables, and one and a half doz tin Sconces, and to take the same into his pos-
session at the end of the Session.

The facts set forth in the Petition against the late election of Sheriffs in Montgomery
County not appearing to be sufficient to invalidate the said Election, and Edward Burgess the
Petitioner not attending to give information Ordered that a Commission issue to Solomon
Holland who appears by the return to have had the greatest number of votes, and Commission
issued accordingly.

The Council adjourned till tomorrow morning.

Thursday 3d. November 1791

The Council met.

Present as on yesterday.

Ordered that the western shore Treasurer pay to Mrs. Ann Levacher Fifteen pounds
for three Months half pay due the ist. instant.

State of Maryland In Council November 3d. 1791

The Board being in possession of the Return from the Counties of Ann Arundel and
Prince George and the City of Annapolis of an Election lately held for the choice of a
Representative of the third District in the Congress of the United States to supply the vacancy
occasioned by the resignation of the Hon'ble William Pinkney Esquire, preceeded to enumerate
and ascertain the number of votes for each and every Candidate; when it appeared that the
hon'ble John Francis Mercer Esquire had the greatest number of votes wherefore it is declared
that the said John Francis Mercer is duly elected a Representative of this State in the Congress
of the United States. Given in Council at the City of Annapolis [p. 352] under the
