Ordered that the western shore Treasurer pay to Benjamin Mackall Esqr. Fifty pounds
for a quarter's Salary as one of the Judges of the Court of Appeals due the 1st. instant.

In Council August 27th. 1791

Joseph Ireland of Calvert County by his Petition sets forth that he has been fined in the
sum of forty pounds Currency for an Assault committed on Doct'r. James Gray, which
fact he acknowledges, but alledges that he had been some time before the commission of it,
assaulted himself by the said Doct'r. Gray, who had moreover traduced and greatly injured
him in his reputation. He refers the Board to a paper accompanying his Petition and con-
taining the substance of the evidence given on the trial to shew that the provocations he had
received were such as would justify (if any thing would) the Assault he made upon Gray,
and prays that on consideration, and on account of the lowness of his circumstances the
Board will remit or lessen the Amount of the fine imposed on him. The aforesaid State of
the evidence is given by a Gentleman of respectable Character who attended the trial and is
certified by the attorney General's deputy for that County to be correct and just; on an
examination of which the Board are of opinion that the fine is too high for the Offence con-
sidering the Circumstances of the Petitioner and the repeated provocations he had received,
and they do therefore order that of the above fine of forty pounds, the sum of thirty seven
pounds be and the same is accordingly remitted.

The Council adjourned 'till Monday morning.
