Friday 22d. October 1790

The Council met.
Present as on yesterday.

In Council October 22d. 1790

John Burgess of Montgomery County by his Petition sets forth, that between November
Court 1789 and March Court 1790 he was desirous of retailing Spiritous liquors, and being
informed that a Magistrate in the recess of the Court had a power to grant a permit to sell,
applied to the Worshipful Mr. Holmes a Justice of the said County for a permit, that on his
application Mr. Holmes granted him a permit to retail 'till March term 1790, and at the same
time informed him that he must apply to the next Court and pay for the time elapsing between
his permit and the Setting of the Court in proportion for the time he had sold under the
permit, that he applied to the Court and obtained a license to retail and paid up for the time
he had retailed under the permit, notwithstanding he was presented at the March Court
aforesaid, and fined the sum of six pounds. The Board having considered the said Petition
and being of opinion that no violation of the law was intended do order [p. 227] and
direct that the aforesaid fine of six pounds be remitted on his paying all the Costs arising
thereon.

Ordered that the western shore Treasurer pay to Richard Snook late a Sergeant in the
2d. Maryland Regiment Twenty pounds, fourteen shillings and two pence for half pay as an
Invalid Pensioner to the 1st. March 1790 per Account passed by the Auditor General.

The Hon'ble. Randolph B. Latimer Esqr. attended

The Council adjourned 'till tomorrow morning.
