In Council July 27. 1790
William Hurst of Queen Anns County by his Petition to the Board, sets forth that he in
partnership with Josiah Hattersly for three or four years previous to the year 1787 kept public
house and the ferry at broad Creek in the County aforesaid, that that they had regularly taken
out licence agreeably to Law, and that the rates of ferriages during that time were uniformly
the same, that the said William Hurst together with his said Partner applied for licence as usual
at the July Court 1787, and had permission granted, for which they paid six pounds and
the Clerks fees; at the same time they applied to the Clerk for the rates of ferriages and could
not obtain them by reason of the hurry of business, but he promised to make out and send them
to the Petitioner, That not knowing of any alteration in the rates and conceiving themselves
safe in receiving them as they before had done, they continued to take the same: for which he
the said William Hurst was alone presented in three several Presentments at July Court 1787
for taking from Passengers crossing the said ferry more than the then new rates, and fined on
each twenty shillings [p. 196].
The Petitioner solemnly declares that he did not know at the time of taking the said excess
of ferriage that there had been any alteration in the rates. He therefore prays a remission of the
fines, and three of the Justices having certified their belief of the facts stated in his Petition:
The Board do order and direct that the said fines amounting to three pounds be remitted on his
paying the Costs arising on the said Presentments.
