therefore pray a remission of the same. And two of the Justices of the Court aforesaid having
recommended the Petitioners to the clemency of Government The Board in consideration of
their indigent Circumstances, do order and direct that the said fines be remitted on Condition
that they pay the Costs accruing on the said Presentments.

William Parker of Montgomery by his Petition sets forth, that at March Court 1787
he applied to the Justices of said County Court, for leave to change a main road, leading
through a Plantation on which he lived and that in consequence of said Petition the Court
appointed Commissioners to examine the location of the road as it then run, and as proposed
to be altered by the Petitioner, That the Commissioners after viewing the same, reported to
the Court that the alteration would be of public advantage, which report being signed by
only one of the Commissioners the Court refused to admit of the report being entered on
Record until the other Commissioner had signed it, The Court declaring at the same time
that if the other Commissioner would sign the same that they would establish the report
which was afterwards done, That he knew the Sentiments of the Commissioner who had not
signed the report, who was then in Washington County perfectly coincided with the other
Commissioner, and being informed that he would not return for a considerable time, and the
Road running immediately through his intended Corn field for that year, he altered the road
agreeably to the report, for which [p. 185] he was presented at August Court 1789
and fined 500 lbs. of Tobacco and Costs of Presentment. He also represents that he has been
reduced by Misfortunes and lately released under the insolvent law, and is unable to pay the
fine, That an Execution hath issued for the recovery of the same, and four of the Magistrates
having certified the facts stated by him to be true, and that they think in justice he ought to be
relieved. The Board in Consideration of all the Circumstances do order and direct that the
said fine of 500 pounds of Tobacco be remitted provided he pays the Costs arising on the same.
