In Council 25th. January 1786
Daniel Wilson of Kent County by his Petition sets forth that Sarah
Culbert his Mother having been ill treated by her Husband, John
Culbert, she made her Complaint to a Magistrate, who requiring
Security for her appearance at the next Court to testify against her
Husband, on behalf of the State, the Petitioner entered into a
Recognizance before the said Magistrate James Claypoole Esqr. on
the 8th. Day of July 1784 in the Sum of Ten pounds Current Money
for his Mother's appearance at the October Court following to
testify as aforesaid. The Petitioner represents that though he was
ignorant of the Consequence of her non-appearance he endeavored to
prevail on her to appear but she refused alledging that her purpose,
vizt. to secure better treatment from her Husband, was already
answered, That in consequence of her failing to appear the Petitioners
Recognizance was forfeited, and he hath since been taken in execution
and imprisoned until he paid the sum forfeited with the Costs accru-
ing thereon, that he hath with great difficulty raised the same and
paid it to George Hanson Esquire Sheriff of the said County, and
now prays that the said Sheriff may be directed to return him the
Sum of Ten pounds forfeited as aforesaid.
The Board having duly considered the Case and a Recommenda-
tion from four of the Justices of the said County in favor of the
Petitioner, are of Opinion that the forfeiture should be remitted and
do therefore direct that the money be returned.
