6o Journal of the State Council, 1784-1789.

Nature could not be communicated to, or exercised by the Clerks,
And it appearing by the said Return that the Ballots in the above
Case were not examined or cast up by the Judges but by the Clerk
it was thereupon adjudged that the said Return was illegal and the
Election void and that a New Writ of Election issue for Sheriff for
said County. And a New Writ issued accordingly.

The Council adjourned 'till tomorrow morning 11 o'clock.

[p 71] Tuesday 28th. October 1785

The Council met.

Present His Excellency William Paca Esquire Governor.

The Honorable

Charles Wallace, Aquila Paca, John Davidson and John H. Stone
Esquires.

The Council adjourned 'till tomorrow morning 11 o'clock.

Saturday 29th. October 1785

The Council met.

Present as on Yesterday.

The Board took into Consideration the Return of the Election
for Sheriffs of Fred'k. County and the Objections made to said
Election by George Jacob Schley in his Petition of the 7th. instant,
and were of Opinion that the said Objections ought to have been
made before the Judges at the time of the Election who alone are
Competent to determine the same and therefore adjudged the said
Return and Election to be Constitutional and Valid and

Commission issued to Thomas Beatty elected Sheriff of Frederick
County.

The Council adjourned 'till Monday Morning 11 o'clock.

Monday 31st. October 1785

The Council met.

Present His Excellency William Paca Esquire.

The Honorable

Charles Wallace, Aquila Paca and John Davidson Esqrs.
The Council adjourned 'till tomorrow morning 11 o'clock.

Tuesday 1st. November 1785

The Council met.

Present as on Yesterday.

This being the Day appointed for hearing the Complaint of James
Shaw against the Election for Sheriffs of Dorchester County the
Parties [p 72] attended but for want of Evidences, the
enquiry was postponed 'till tomorrow morning 10 o'clock.

The Council adjourned 'till tomorrow morning, 10 o'clock.
