98 Provincial Court Proceedings, 1681.
Liber W. C. here in Court produced whose date is the day and yeare above
written Did owe and Stand Justly indebted unto Mr William Drope
and Mr Thomas Ellies of London Marchants in the full Sume and
Just Quantity of Three thousand nine hundred & Seaventeene pounds
of good sound Marchantable Tobacco and Caske To be payd to the
said Mr William Drope and Mr Thomas Ellies or either of them
their or either of their heires Executors Admrs or assignes at some
Convenient place in Ann Arundell County not exceeding half a Mile
from the water side, To the wch Payment well and truely to be made
the said John Barnes Did binde himself his heires Executors and
Admrs firmely by those prsents. Notwithstanding WCh the said John
Barnes the said full sume and Just Quantity of Three thousand Nine
hundred and seaventeene pounds of Tobacco to the said William
Drope and Thomas Ellies or to either of them hath not paid or
satisfyed Although often thereunto required, but the Same to pay
hitherto hath Denyed and still doth denye, Whereupon they the said
William Drope and Thomas Ellies say they are Damnifyed & have
Lost to the Value of six Thousand pounds of Tobacco And there
upon they bring their Suite
And the said John Barnes by Kenelm Cheseldyn his Attorney
Cometh and defendeth the force and Injury when &c and prayeth
Liberty to Imparle hereunto untill next Provinciall Court and It is
granted unto him the same day is given to the plantiffe Likewise
Now here att this Day to wit the Eighteenth day of November
in the sixth yeare of the Dominion of the Right honoble Charles Lord
Baltemore &c Annoq Doni 1681 Came the said William Drope and
Thomas Ellues by their Attorney aforesaid and Offered themselves
against the said John Barnes in the plea aforesaid, but the said John
Barnes came not but made Default Therefore itt is Considered by
the Court here That the said William Drope & Thomas Ellues Re
cover against the said John Barnes aswell the aforesaid Sume of
Three thousand Nine hundred and Seaventeene pounds of tobacco
Debt as also the sume of Nine hundred and foure pounds of Tobacco
for Costs of suite, and the said Deft in Mercy &ca
John Shrigley In Ejectmt John Sallers late of Ann Arundell
agt County in the province of Maryland
John SallersPlanter was attached to answere unto
John Shrigley of the same County
Cooper of a plea wherefore by force and Armes into all that parcell
of Land called Hunts Mount Lyeing in the County of Ann Arundell
p. 481 on the west side of the Herring Creek Att the head of Land formerly
Laid out unto Samuel Chew and unto Edward Carter & ffrancis
Holland To be holden of the Mannor of St Maryes Containing Three
hundred and fifty Acres more or Lesse Together wth all houses
Edifices buildings Gardens Stables Orchards, and all other the
