And whereupon the said Robert & Ann by Kenelm Cheseldyn their
Attorney complaineth, that whereas the said Matthew in his life
tyme was indebted the Sume of two thousand pounds of tobacco to
one Edward Rooke of London in the Kingdome of England, the
said Matthew in consideracon that the said George Macall would
pay the said two thousand pounds of tobacco to the said Edward &
take in the bill so as aforesaid passed to the said Edward, the said
Matthew the tenth day of May One thousand six hundred Seventy
five did assume upon himselfe & to the said George did faithfully
promise that he the said Matthew would pay to the said George
when required the said Sume of two thousand pounds of tobacco
And the said Robert & Ann in fact saith, that the said George in his
life tyme did pay the said two thousand pounds of tobacco to the
said Edward as aforesaid, & did take in the said Matthews bill passed
as aforesaid Notwithstanding which the said Matthew in his life
tyme nor the said Mary since his death though often thereunto
required the same hath not paid to the said George in his life tyme
nor to the said Robert & Ann since his death Execrs of the last Will
& Testamt of the said George, but the same to pay hitherto hath &
still doth deny to pay to the damage of the said Robert & Ann the
sume of foure thousand pounds of tobacco And the said Robert &
Ann bring here in Court the Letters testamentory of the said George
to her granted that itt may appeare that she is Execrs of the said
George

unto Robert Graham & Ann his wife
Execrs of the last Will & Testament of
George Macall deceased in a plea of tres-

And whereupon the said Robert & Ann by Kenelm Cheseldyn their
Attorny complaine, that whereas one John Rodway of Talbot County
in his life tyme was indebted to the said George Macall in his life
tyme the sume of twelve thousand two hundred & thirteen pounds
of tobacco the said John Rodway did deliver unto the said George
severall persons bills liveing in the said County of talbot & upon
the Eastern shore, together with a Letter of Attorney for to recover
the same for the satisfaction of the debt aforesaid due to the said
George a particuler of which bills are here in Court produced amount-
ing to the said sume of twelve thousand two hundred & thirteen
pounds of tobacco And the said George being desirous to imploy
some skillfull & honest person to receive the same, the said Matthew
Ward the fifteenth day of December in the yeare of our Lord One
thousand six hundred seventy foure in consideracon that the said
