pounds of tobacco, upon himselfe did assume & to the said Robert
did then & there faithfully promise that he the said William the said
twenty foure thousand three hundred seventy Eight pounds of to-
bacco to the said Robert upon all demands would well & truely pay
& content And whereas also the said William afterwards to witt
the said twenty Eighth day of November in the said yeare of our
Lord One thousand six hundred Seventy & one here att St Maryes
aforesaid within the liberty &c was indebted unto the said Robert
in the sume & quantity of twenty foure thousand three hundred
seventy Eight pounds of tobacco for divers Merchandizes & Mer-
chantry wares to the said William by the said Robert before that
tyme sould & delivered And being so thereof indebted he the said
William afterwards to witt the twenty ninth day of November in the
yeare & place aforesaid within the liberty aforesaid in consideration
thereof upon himselfe assumed & to the said Robert then & there
faithfully promised, that he the said William the said Twenty foure
thousand three hundred seventy Eight pounds of tobacco last men-
coned when thereunto requested would likewise well & truely con-
tent & pay, which said severall Sumes in the whole amount unto
fforty eight thousand seven hundred fifty & six pounds of tobacco
Yett the said Wm his severall promises & assumpcons in forme afore-
said made not reguarding, but endeavouring & fraudulently intend-
ing the said Robert of the said fforty eight thousand Seven hundred
fifty & six pounds of tobacco in this behalfe craftily & subtily to
deceive & defraud, the same to the said Robert according to his
severall promises & assumpcons aforesaid hath not paid nor him for
same in any wise contented, although so to doe the said William
afterwards to witt the last day of December in the yeare & place

Aforesaid here att St Maryes aforesaid & within the liberty afore-
said was by the said Robert thereunto requested but the same to him
to pay hath hitherto refused & yet doe refuse to the damage of him
the said Robert of fforty Eight thousand seven hundred fifty six
pounds of tobacco & thereupon he bringeth his suite &c
And the said William Colebourne by Robert Ridgely his Attorney
cometh & defendeth the force & injury when &c and prayeth liberty
to imparle hereunto untill next Provinciall Court & itt is granted unto
him, the same day is given to the plaintiffe also
Now here att this day to witt the twelfth day of March in the
fourth yeare of the Dominion of Charles Lord Baltemore &c Annoq
Doni 1678 cometh the said parties by their Attorneys aforesaid And
the said William by his said Attorney saith, that he did not assume
& promise in manner & forme as the said Robert Williams above
against him hath declared, & of this he putts himselfe upon the
Country And the said Robert Williams also Whereupon itt is co-
manded the Sheriffe of St Maryes County that he cause to come
here twelve &c by whom &c and who neither &c to recognize &c
