Accompts untill this prsent fifth day of October Upon which day we
ordered the said parties to appeare before us as by a certaine write-
ing under our hands & Seales more att large appeareth And this day
came before us Mr Christopher Rousby Attorney for the said
Richard Covell & Mr Kenelm Cheseldyn Attorney for the said
Edward Gunnell And whereas the said Richard Covell chargeth
the said Edward Gunnell with an accompt of severall bills had &
received by him the said Richard amounting to the sume of thirteen
thousand three hundred thirty seven pounds of tobacco Which said
bills were by Mr Kenelm Cheseldyn Attorney for the said Edward
Gunnell acknowledged to have bin received by the said Edward Gun-
nell & nothing appearing to us why the said Sume of Thirteen thou-
sand three hundred thirty seven pounds of tobacco should not be
paid unto the said Richard Covell or the severall bills returned in
kinde Wee therefore humbly report to yor Honors that the said Gun-
nell is indebted unto the said Richard Covell the just Sume of
Twelve thousand five hundred thirty seven pounds of tobacco Eight
hundred pounds of tobacco being thought convenient to be deducted,
so much being paid Mr Robert Carvile for sueing Henry Mitchell
by the said Edward Gunnell But whereas Mr Kenelm Cheseldyn
alleadgem & doth averr before us that there is several bills now in
the hands of the said Gunnell ready to be delivered, but that he
verily thinks the said Gunnell is sick & can not come If therefore
any of the said bills in the list menconed be returned & delivered
unto the said Richard or to his certaine Attorney by the first day of
the next Provinciall Court, then we thinke itt reasonable & fitt to
allow of them & deduct them or what is really due of them out of
the aforesaid Suine of twelve thousand five hundred thirty seven
pounds of tobacco Likewise Mr Kenelm Cheseldyn doth alleadge
that there was six hogsheads of tobacco received of Henry Mitchell
upon accompt of Richard Covell & marked with his proper marke,
which said six hogsheads of tobacco were stolne out of the tobacco
house of the said Henry Mitchell If therefore yor Honors thinke
fitt & reasonable to allow of the said six hogsheads of tobacco & to
deduct them out of the said Sume of twelve thousand five hundred
thirty seven pounds of tobacco we likewise thinke soe And we thinke
fitt that the said Edward Gunnell pay six hundred thirty six pounds
