And the said Wm Lacy by Robert Ridgely his Attorney cometh
& defendeth the force & injury when &c but the said Thomas Parker
came not but made default Therefore itt is considered by the Court
here this day to witt the Eleventh day of Octobr in the third yeare
of the Dominion of Charles Lord Baltemore &c Annoq Doni 1678
that a Nonsuite be awarded against the said Thomas Parker And
that the said Wm Lacy recover against the said Thomas Parker the
sume of Eight hundred thirty six pounds of tobacco for his costs &
charges by him about his defence in this behalfe laid out & expended
And the said Thomas in mercy for his false claime

Comand was given to the Sheriffe of St Maryes
County, that he Attach any the Goods or Chattells
of ffrancis Gunby if they should be found in his
bailywick to the value of five thousand six hundred
|

& forty pounds of tobacco And when he had the same so Attached
or any part thereof of the same in his custody to keep untill the said
ffrancis Gunby should by himselfe or his Attorney appeare here the
Eighth day of October in the third yeare of the Dominion of Charles
Lord Baltemore &c Annoq Doni 1678. to Answer unto Rober Car-
vile gentl in a plea that he render unto him the sume of ffoure thou-
sand two hundred & thirty pounds of tobacco which to him he oweth
& unjustly detaineth Att which said Eighth day of October in the
yeare aforesaid the same Sheriffe maketh return of the writt afore-
said that by vertue thereof he hath Attached one Mare & Colt of
the said ffrancis Gunby's appraised att One thousand six hundred
pounds of tobacco Whereupon the said Robert Carvile prayed that
the said Mare & Colt might be condemned for part of satisfaction of
the debt aforesaid & itt is granted, the said Robert Carvile giveing
security according to Act of Assembly in that case made & provided
Att which said Eighth day of October in the yeare aforesaid came
the said Robert Carvile with Garret VanSweringen his security who
undertooke for the said Robert to indemnifie the Court upon the
Attachmt aforesaid And to make restitucon of the said Mare & Colt
or of the Value thereof to the said ffrancis Gunby in case the said
ffrancis or his Attorney shall within one yeare & a day make his just
defence to & proceed on in the said action in corhon forme, & make
itt appeare that the said Robert Carvile is satisfied his just demand
or any part thereof according to the true intent & meaning of a cer-
taine Act of Assembly in that case made & provided.
