And the said Henry & Sybill by George Parker their Attorney
came & defend the force & injury when &c and pray liberty to
imparle hereunto untill next Provinciall Court & itt is granted unto
them-, the same day is given to the plaintiffe likewise
Now here att this day to witt the Sixteenth day of October in
the third yeare of the Dominion of Charles Lord Baltemore &c
Annoq Doni 1678 cometh as well the said plaintiffe as the said
Defendts by their Attorneys aforesaid And the said Henry & Sybill
by their said Attorney say, that the said Richard his action afore-
said against them ought not to have, because they say that the said
Wm Groome in his life tyme did fully accompt with the said Richard
Bankes for all such Sumes of tobacco as he had received for the said
Richard And what bills or Accompts were left unreceived he re-
turned the same againe in kinde to the said Richard, all which they
are ready to averr, & demand judgmt if the said Richard his action
aforesaid ought to haue against them And the plaintiffe also Which
Declaracon & plea aforesaid being read, itt appeareth to the Justices
here that the said Wm Groome did in his life tyme receive for the
use of the said Richard Bankes the sume of Seven thousand six
hundred & seven pounds of tobacco Therefore itt is considered that
the said Richard Bankes recover against the said Henry Jowles &
Sybill his wife Execx as aforesaid as well the sume of Seven thou-
sand Six hundred & seven pounds of tobacco damages occasioned by
the prmisses As also Eight hundred fifty six pounds of tobacco costs
of suite And the Defend" in mercy &c
