38 Provincial Court Proceedings, 1678.

& still doth deny & refuse to the damage of the said Thomas tenn
Thousand pounds of tobacco & thereupon he bringeth his suite.
And the said Richard Baily by Kenelm Cheseldyn his Attorney
conieth & defendeth the force & injury when &c And saith that he
can say nothing in barr of the action of the said Thomas Marsh,
but that the said Thomas ought to recover against the said Richard
the aforesaid S ume of five thousand two hundred pounds of tobacco
Therefore itt is considered by the Court here this day to witt the
Eleventh day of October in the third yeare of the Dominion of
Charles Lord Baltemore &c Annoq Domini 1678 that the said
Thomas Marsh recover against the said Richard Baily as well the
sume of ffive thousand two hundred pounds of tobacco debt As
also pounds of tobacco costs of suite And the
Defendt in mercy &c
Mr Cheseldyne
I desire you to appeare for me att the suite of Thomas Marsh,
and confesse judgemt for me in an action of debt for ffive thousand
two hundred pounds of tobacco with costs of suite And see my bill
delivered upp & cancelled And for yor so doeing this shall be your
sufficient warrant As wittnes my hand & Seale this ninth day of
October Anno Doni 1678

Bee it remembred that upon the Eleventh day of
October in the yeare of our Lord One thousand six
hundred Seventy Eight came Robert Purington of
St Maryes County who as well for the Honble his

Lordpp the Lord Propry as for himselfe followeth
in his proper person & exhibitteth to the Justices here his certaine
Informacdn against Thomas Wynn Deputy or UnderSheriffe of
the County of St Marys And Cryer of this Court here prsent in
Court, the tenour of which Informacon followeth in these words
Bee itt remembered that Robert Purrington of St Maryes County
who as well for his Lordpp the Lord Propry as for himselfe fol-
loweth giveth the Court here to understand & be informed That
whereas by Act of Assembly made att a Generall Assembly begun &
held att the City of St Maryes the fifteenth day of May in the yeare
of our Lord One thousand six hundred Seventy six Intituled an
Act for lymitacon of Officers frees, itt was amongst other things
Enacted, that from & after the publicacon thereof no Officer or
Officers thereafter menconed their Ministers Servants or Deputies by
reason or colour of his or their Office or Offices have received or
taken of any person or persons directly or indirectly any other ffees
