duced did upon the tenth day of September in the yeare of our Lord
One thousand six hundred seventy foure confesse himselfe Debtor
to the said Peter Quodman the Suine of twenty nine pounds five
shillings & six pence money sterl being the produce of twelve hogs-
heads of tobacco Shipped home for England upon the account of the
produc[e] of the said Goods As also the sume of Six thousand &
Seventy pounds of tobacco for debts secured in his the said John
Gilberts own name as then yet unpaid In consideracon whereof the
said John Gilber[t] did assume upon himself & to the said Peter
Quodman faithfully promise that he the said John Gilbert the said
sume of Twenty nin [e] pounds five shillings & six pence stert & Six
thousand & Seventy pounds of tobacco to him the said Peter when
thereunto lawfully requested would well & truely content & pay Yet
notwithstanding the said John Gilbert in his life tyme nor the said
John Browning his Admr since his death the said Sume of Twenty
nine pounds five shillings & Six pence stert to him the said Peter hath
not paid or satisfied though often thereunto requested, but the same
to pay hath hitherto denyed & refused & still doe deny the same to
the damage of the said Peter Twenty thousand pounds of tobacco
and thereupon he bringeth his suite
And the said John Browning by Robert Carvile his Attorny com-
eth & defendeth the force & injury when &c and saith that he can say
nothing in barr of the action of the said Peter, but that the said
Peter the said severall Sumes declared for ought to recover ou[t]
of the Estate of the said John Gilbert when assets comes to the hands
of the said John Browning his Admr Therefore itt is considered by
the Court here this Eleventh day of October in the third yeare of the
