George Robins Coronr of Talbot County haveing formerly returned a cepi in this cause And the Defendt not appearing this Court, the said George is amerced forty shillings, & ordered yt he have

the body of the Defend^t here att the next Provinciall Court

Wm Dare agt Richard Ladd & ux Exx Joseph Horsley Jonathan Sibrey agt Charles Howell

These two actions are continued untill next Court

p. 703 Wm Smith agt Robt Neale

Robert Neale late of Charles County otherwise called Robert Neale of St Maryes County in the Province of Maryland was Sumoned to Answer unto Wm Smith of a plea that he render unto him two thousand six hun-

dred pounds of tobacco which to him he oweth & unjustly detameth
And whereupon the said W^m by Henry Bonner his Attorney saith,
that whereas the said Robert upon the twenty ninth day of January
One thousand six hundred seventy six by his certaine writeing
obligatory Sealed with the Seale of him the said Robert & here in
Court produced whose date is the day & yeare abovesaid did acknowl-
edge himselfe to owe & stand firmly indebted unto the said W^m in
the sume of two Thousand six hundred pounds of good sound
M^rchantable tobacco & cask to be paid to the said W^m conveniently in
Pickawaxen Creek att or beiore the tenth day of Decemb^r next
ensueing the date thereof Yet notw^thstanding the said Robert the
said Sume of two Thousand six hundred pounds of tobacco to him
the said W^m though often thereunto requested according to the said
writeing Obligatory hath not rendred or paid, but the same to him
to render or pay hath hitherto denyed & refused & still doth deny &
refuse to the damage of the said W^m three thousand foure hundred
pounds of tobacco and thereupon he bringeth his suite

And the said Robert Neale by Nehemiah Blakiston his Attorney
cometh & defendeth the force & injury when &c and prayeth liberty
to imparle hereunto untill next Provinciall Court & itt is granted
unto him, the same day is given to the plaintiffe also

Now here att this day to witt the Eleventh day of Octob^r in the
third yeare of the Dominion of Charles Lord Baltemore &c Annoq
Doni 1678 cometh as well the said W^m Smith as the said Robert
