Att which said next Provinciall Court to witt the fourteenth day
of March in the fourth yeare of the Dominion of Charles Lord
Baltemore &c Annoq Dni 1678. came the said Mary Warde by her
Attorney aforesaid & offered herselfe against the said Thomas Patti-
son in the plea aforesaid, but the said Thomas came not, neither did
he putt in any plea to the plts declaracon, whereupon the said Mary
Warde remaineth agt the said Tho: Pattison thereof wholy un-
defended And the said Thomas Pattison by his Attorney aforesaid
moved the Court in Arrest of judgmt day was thereupon given unto
the said Tho: Pattison to putt in his reasons for Arresting the same
untill next Provinciall Court, the same day is given to the plt also
Now here att this day to witt the Seventh day of June in the
fourth yeare of the Dominion of Charles Lord Baltemore &c Annoq
Doni 1679. came as well the said plt as the said Defendt by their
Attorneys aforesaid And the said Defendt by his said Attorney putt
in his reasons for the Arrest of judgmt aforesaid which followeth in
these words Vizt
For that att a Sessions of Assembly begun & holden att the City
of St Maryes upon the ffifteenth day of May in the first yeare of the
Dominion of the right Honble Charles Lord & Propry of this Province
& continued by divers Prorogations untill the twentieth day of Octo-
ber in the third yeare of the Dominion of the same Charles Annoq
Doni 1678. was made & continued a certaine Act of Assembly en-
tituled an Act for Easement of the Inhabitants of this Province in
suites att Law for small debts, wherein amongst other things itt was
Established Ordained & Enacted, That no action for booke debt or
upon a plaine bill for or under the Sume of ffifteen hundred pounds
of tobacco & caske shall be comenced or prosecuted against any
Inhabitant of this Province in the Provinciall Court of this Province
Except only upon Appeales from the County Courts of this Province
And the Attorneys of the Provintiall Court & County Courts for
their ffees only And for that the action by the aforesaid pR against
the aforesaid Defendt brought it upon a plaine bill under the Sume
of ffifteen hundred pounds of tobacco & not for Attorneys ffees,
Therefore judgmt ought not to be entred upon the same in this Court
contrary to the Act aforesaid. Which being read & heard the plain-
tiffe by her Attorney aforesaid saith nothing in barr why judgmt
should not be Arrested. Therefore itt is considered that judgemt
upon the action aforesaid be stopped & Arrested And that the said
Thomas Pattison goe thereof without day
