said amounts to in the whole but the Sume of Nineteen thousand &
Sixty pounds of tobacco, Whereas the declaration is for twenty
foure thousand Eight hundred eighty & two pounds of tobacco,
which account ought to haue agreed with the said declaracon And
to have showne to the Court how the same twenty foure thousand
Eight hundred Eighty & two pounds of tobacco came due to the said
plt And what Goods they were he sould to the said Defendt yt
amounted unto the said Sume of twenty foure thousand Eight hun-
dred Eighty & two pounds of tobacco the said 4th of August One
thousand six hundred seventy five
The said Defendt for the Errors aforesaid desires that judgmt of
this Court upon the Verdict aforesaid against this Defendt may be
stopped & Arrested. Which being read & heard, the plt by his Attor-
ney aforesaid saith nothing why judgmt upon the Verdict aforesaid
should not be Arrested Therefore itt is considered that judgmt upon
the Verdict of ye jurors aforesaid be stopped & Arrested And that
the said John Quigley goe thereof without day

otherwise called Thomas Pattison of Dorchister
County was Sumoned to Answer unto Mary
Warde Execrs of the last Will and testamt of
Matthew Warde of a plea that he render unto

her the sume of Eight hundred pounds of tobacco which from her
he unjustly detaineth
And whereupon the said Mary Warde by Robert Carvile her At-
torney saith, that whereas the said Thomas Pattison upon the sev-
enth day of Decembr Annoq Doni One thousand six hundred Sev-
enty six, by his certaine bill or writeing obligatory Sealed with the
Seale of him the said Thomas Pattison & here in Court produced
whose date is the day & yeare above written, did confesse himselfe
to owe & stand firmly indebted unto the said Matthew Warde in
the tull & just Sume of Eight hundred pounds of tobacco & caske
upon demand in some convenient place in Chester river in the County
of Talbot Yet notwithstandinging the said Thomas the said Sume
of Eight hundred pounds of tobacco to the said Matthew in his life
tyme or to the said Mary Warde since his death though often there-
unto requested hath not paid or satisfied but the same to pay & satisfie
hath hitherto denyed & still doth deny & refuse to the damage of the
said Mary Eight hundred pounds of tobacco & thereupon she bring-
eth her suit And she bringeth here into Court the Letters testamen-
tory, by which itt may appeare to the Court here that she is Execrs &
hath Admcon &c

And the said Thomas Pattison by Charles Boteler his Attorney
cometh & defendeth the force & injury when &c and prayeth liberty
to imparle hereunto untill next Provintiall Court, & itt is granted
unto him, the same day is given to the plt also
|
