Attorneys of this Court here in Court in his proper pson of a plea of
trespas upon the case.
And whereupon the said W^m Bradford by Christopher Rousby
his Attorney complaineth, that whereas the said Peter Sayer the
nineteenth day of January One thousand six hundred Seventy seven
att the store of him the said W^m in Wye river in Talbot County
within the Province aforesaid in consideration that he the said
W^m att the special instance and request of him the said Peter had
bargained sould & deliuered unto him the said Peter divers Goods &
M^rchandize a particuler whereof is here in Court produced, amount-
ing according to the rates for which the same Goods & M^rchandize
were sould to the sume of twelve hundred forty & eight pounds of
tob: And also in consideracon that he the said Peter the said Nine-
teenth day of January One thousand six hundred Seventy seven
att the like special instance & request of him the said Peter bought &
received of him the said W^m att the store aforesaid tenn Gallons of
Spiritts or liquor called Brandy att the rate of thirty fiue pounds of
tobacco p Gallon amounting to three hundred & fifty pounds of
tobacco, did assume upon himselfe & to the said W^m did faithfully
promise, that the said Peter the said several Sumes of twelve hun-
dred forty eight pounds of tobacco & of three hundred & fifty pounds
of tobacco in all amounting to ffifteen hundred ninety Eight pounds

of tobacco unto the said William when thereunto required well &
truely would pay & satisfie yet the said Peter his promise & assump-
con aforesaid little reguarding but plotting & fradulently intending
him the said W^m of the said ffifteen hundred ninety eight pounds of
tobacco craftily to deceive, the same ffifteen hundred ninety eight
pounds of tobacco or any parcell thereof unto the said W^m hath not
paid and satisfied although often thereunto required but the same to
pay hath denyed & still doth deny to the damage of the said W^m two
thousand six hundred pounds of tobacco And thereupon he brings
his suite
And the said Peter Sayer by Robert Ridgely his Attorney cometh
& defendeth the force & injury when &c and prayeth liberty to im-
parle hereunto untill next Provintiall Court & itt is granted unto him,
the same day is giuen to the p^lt also
Now here att this day to witt the Sixth day of June in the fourth
yeare of the Dominion of Charles Lord Baltemore &c Annoq Doni
1679. cometh as well the said W^m Bradford as the said Peter Sayer
by their Attorneys aforesaid, And the said Peter by his said Attorney
saith, that he hath nothing to say in barr of the action of the said
W^m whereby the said W^m remaineth against the said Peter thereof
undefended Therefore itt is considered that the said W^m Bradford
recover against the said Peter Sayer as well the Sume of ffifteen
hundred ninety Eight pounds of tobacco damages As also
pounds of tobacco costs of suite And the Defend^t in
mercy &c.
