Elizabeth Wincles late of Talbot County Admx of
the Goods & Chatties Rights & Creditts of Edward
Wincles deceased & Edward Pynn, otherwise

called Edward Wincles & Edward Pynn were
Sumoned to Answer unto Henry Ward of a plea that they render
unto him the Sume of ffoure thousand pounds of tobacco which
from him they unjustly detaine.
And whereupon the said Henry by Robert Carvile his Attorney
saith, that whereas the said Edward Wincles & Edward Pynn upon
the sixth day of Septembr Anno Doni One thousand six hundred
Seventy seven by their certaine bond or writing obligatory Sealed
with the Seales of them the said Edward & Edward & here in Court
produced whose date is the day & yeare abovesaid, did confesse &
acknowledge themselves to be holden & firmly bounden unto the said
Henry in the full & just Sume of foure thousand pounds of sound
Mrchantable tobacco & cask to containe the same, to be paid upon
all demands after the tenth day of Octobr then next, & for the true
performance whereof they did binde themselves their heyres Exec™
& Admrs firmly by those prsent Yett notwithstanding the said Edward
Wincles in his life tyme nor the said Elizabeth Wincles since his
death, nor the said Edward Pynn the said Sume of foure thousand
pounds of tobacco to him the said Henry though often thereunto
requested have not paid or satisfied, but the same to pay and satisfie
have hitherto denyed & refused & still doe deny and refuse, to the
damage of the said Henry five thousand pounds of tobacco & there-
upon he bringeth his suite.
And the said Edward Pynn by Christopher Rousby his Attorney
cometh & defendeth the force & injury when &c & saith he hath
nothing to say in barr of the said action above declared, but that
the said Henry should recover agt the said Edward Pynn the said
Sume of ffoure thousand pounds of tobacco Therefore itt is con-
sidered by the Court here this day to witt the fourth day of June
in the fourth yeare of the Dominion of Charles Lord Baltemore &c
Annoq Doni 1679 that the said Henry Ward recover agt the said
Edward Pynn as well the Sume of ffoure thousand pounds of
tobacco debt As also five hundred fifty two pounds of tobacco costs
of suite And the Defendt in mercy &c
Mr Christopher Rousby April 4th 1679.
Sr I desire you to appeare in my behalfe as my Attorney in the
Provintiall Court next June, to answer unto an action of debt of
foure thousand pounds of tobacco prosecuted against me by Mr Henry
Ward, to confesse judgemt thereunto wth stay of Execution untill
