the will of him the said Morgan, & against the Lawes & Customes of
this Province of Maryland in prison did keep & detaine, & other
harmes to him did doe, against the peace of the right Honble the
Lord Propry & to the damage of the said Morgan Jones tenn thou-
sand pounds of tobacco & thereupon he bringeth his suite
And the said Nicholas & Charles by Robert Ridgely their Attorney
come & defend the force & injury when &c and pray liberty to imparle
hereunto untill next Provintiall Court & itt is granted unto them, the
same day is given to the plt also
Now here att this day to witt the Seventh day of June in the
fourth yeare of the Dominion of Charles Lord Baltemore &c Annoq
Doni 1679 cometh as well the said plt as the said Defendts by their
Attorneys aforesaid And the said Defendts by their said Attorney
say, that they of the trespas assault and imprisonmt aforesaid sup-
posed to be done, that they in nothing are thereof guilty as the afore-
said Morgan hath above against them complained And of this they
putt themselves upon the Countrey And the said Morgan Jones also
Therefore itt is Comanded the Sheriffe of St Maryes County that he
cause to come here twelve &c by whom &c and who neither &c to
recognize &c because as well &c On which said Seventh day of June
in the yeare aforesaid cometh as well the said plt as the said Defendts

by their Attorneys aforesaid And the jurors impanneld Being called
likewise came to witt John Evans, Stephen Murty, Samuell Asbiston,
Richard Sweatnam, Anthony Evans, Nicholas Racket, Robert Smith,
Henry Penington, James Harrison, John Watson, Robert Toate &
Elias Beech who being Elected tryed & sworne to say the truth in
the prmisses upon their Oaths doe say that the said Defendts are not
Guilty of the trespas assault or imprisonmt aforesaid above supposed
to be done Therefore itt is considered that the said Morgan take
nothing by his writt but be in mercy for his false claime And that the
said Nicholas & Charles goe thereof without day And also that the
said Nicholas ffurnes and Charles Bathurst recover against the said
Morgan Jones the Sume of One thousand thirty one pounds of
tobacco for their costs & charges by them about their defence in this
behalfe laid out & expended And the said Nicholas & Charles may
have thereof Execution &c
