&c and who neither &c to recognize &c because as well &c On which
said sixth day of June in the yeare aforesaid cometh as well the said
plaintiffe as the said Defend^t by their Attorneys aforesaid And the
jurors impannelled being called likewise came to witt John Evans,
Stephen Murty, Samuel Asbiston, Richard Sweatnam, Anthony

Evans, Robert Peca, Nicholas Hacket, Robert Smith, John Watson,
Theophilus Turford, Henry Penington & James Harrison who being
Elected tryed and sworne to say the truth in the p^rmisses, the plain-
tiffe although solemnly called appeares not, whereupon a Nonsuite
is awarded against him And itt is considered that the said p^lt take
nothing by his writt, but be in mercy for his false claime And that
the Defend^t goe thereof without day And that the said W^m Chandler
recover against the said John Machen the Sume of Two thousand
eighty and six pounds of tobacco for his costs & charges by him
about his defence in this behalfe laid out & expended And the said
W^m Chandler may haue thereof Execucon
