comand you that the Record & proces of the said judgmt with all
things touching the same before our Justices of our Provintiall
Court to be held att our City of St Maryes the third day of June
next under your hands & Seales distinctly & openly you send, that
inspection being had of the Record & proceedings therein we may
cause further to be done what of right & according to the Lawes &
Constitucons of this our Province ought to be done therein And
that you have there this writt Wittnes our scale att our City of
St Maryes the two & twentieth day of March in the fourth yeare of
our Dominion Annoq; Doni One thousand six hundred Seventy
eight.
Att which said third day of June in the yeare of our Lord One
thousand six hundred Seventy nine Mr Richard Woolman, Capt
Philemon lLoyd, Mr Anthony Mayle, & Capt George Cowley Comis-
sionrs of the said Talbot Court to his Lordpps Justices of the Pro-
vintiall Court att the City of St Maryes the transcript of the Records
of the proceedings & judgemt of the said Talbot County Court under
their hands & scales haue sent according as by the said writt they
were Comanded, The tenour whereof followeth in these words Vizt
Att a Court holden for Talbot County by his Lordpps Justices
of the peace the Seventeenth day of Septembr in the third yeare of
the Dominion of Charles &c Annoq Donie One thousand six hun-
dred Seventy eight. Justices prsent

In a plea of trespas upon case.

Talbott ss
Ralph ffishborne of the County aforesaid was Attached to answer
unto Humphry Davenport that he render the said Humphry twelve
hundred & thirty pounds of good sound tobacco & cask which he
unjustly detaineth
Whereupon the said Humphrey by James Coursey his Attorny
saith, that the said Ralph stands justly indebted to the said Hum-
phrey in the sume of twelve hundred & thirty pounds of tobacco as
by accompt thereof ready to be produced in Court may appeare Not-
withstanding the said Ralph the said tobacco nor any part thereof
to the said Humphry hath paid to the damage of the said Humphrey
two thousand pounds of tobacco, & thereupon he bringeth his suite
And the aforesaid Ralph Fishborne by Thomas Vaughan his
Attorney comes & defends the injury &c requireth that the said
Humphrey may prove his accompt
