the prmisses, the plaintiffs although solemnly called to receive the
Verdict of the jurors aforesaid came not Therefore itt is considered
that a Nonsuite be awarded against them And that the plts take
nothing by their writt, but be in mercy for their false claime And
that the Defendt goe thereof without day

Whereas Samuell Leadbeater by his Letter of Attorney dated
the Sixteenth day of March One thousand six hundred Seventy
six hath Deputed Constituted & empowered me to be his Attorney
And whereas there are severall actions comenced att the Provintiall
Court against the said Leadbeater I doe hereby authorize & empower
you Robert Ridgely to be my Attorney in the said Court on behalfe
of the said Leadbeater, & to appeare there, & defend an action
comenced against the said Leadbeater in the said Court by the Exrs
of Cuningham And for so doeing this shall be yor warrant Wittnes
my hand & Seale this ninth of October One thousand six hundred
seventy Eight

Memorandum that the two & twentieth day of
March in the fourth yeare of the Dominion of
Charles &c Annoq Doni 1678. came Ralph
ffishborne by Robert Ridgely his Attorney be-

fore the Honble Philip Calvert Esqr Chancelour of this Province, &
prayed his Lordpps writt of Error to the said Ralph ffishborne to be
granted to the Coinissioners or Justices of his Lordpps County
Court of Talbot County to be directed to require them the said
Comissionrs of the said County Court of Talbot County to send
before his Lordpps Justices of his Provintiall Court att the City of
St Maryes the third day of June then next following the tenor of
the Record proceedings & judgemt of the said Talbot County Court
in a case lately depending between Humphry Davenport plaintiffe &
the said Ralph ffishborne Defendt & itt is granted unto him. the
tenour of which said writt follows in these words

Charles &c To our Comission" of our County of Talbot greet-
ing Because in the Record & proces as also in the rendring of
judgemt before you in our said Court against Ralph ffishburne att
the suite of Humphrey Davenport mannifest Error hath happened
to the great damage of the said Ralph ffishborne as by the great
complaint of the said Ralph we haue received, we willing that the
Errors (if any be) should in due manner be corrected & full &
speedy Justice to be done to the said parties in this behalfe, doe
