penter of a plea that he render unto him the full & just quantity of
three thousand five hundred sixty one pounds of good sound Mrchant-
able tobacco & cask which to him he oweth & unjustly detaineth
And whereupon the said Richard Sweatnam by Robert Ridgely
His Attorney saith, that whereas the said John Blomfield the nine-
teenth day of April Anno Doni One thousand six hundred Seventy
eighth by his certaine bill obligatory sealed with the Seale of him the
said John Blomfield & here in Court produced whose date is the day
& yeare aforesaid, did acknowledge himselfe to be holden & firmly
bounden unto Richard Sweatnam of the same City Carpenter in
the full & just quantity of three thousand five hundred sixty one
pds of good sound Mrchantable tobacco & cask, to be paid to the
said Richard or to his certaine Attorney his Execrs Admrs or assignes
conveniently upon the tenth day of November next ensueing the date
of the same bill obligatory To the wch payment well & truely to be
made the said John Blomfield did binde himselfe his heyres Exrs &
Admrs firmly by those prsents Notwithstanding which the said
Jno Blomfield the said Sume of three thousand five hundred sixty
& one pounds of tobacco to him the said Richard Sweatnam accord-
ing to the tenour of the said Bill although often thereunto required
hath not paid or satisfied, but the same to pay or satisfie hath denyed
& as yet doth deny, whereupon the said Richard Sweatnam saith he
is damnified & hath losse to the value of foure thousands pounds of
tobacco, & thereupon he bringeth his suite
And the said John Blomfield in his proper person cometh & de-
fendeth the force & injury when &c and saith that he cannot gain-
say the aforesaid action of the said Richard Sweatnam, for that he
hath not paid unto the said Richard the aforesaid quantity of three
thousand five hundred Sixty & one pounds of tobacco in discharge
of the said recited bill obligatory according to the forme & effect
thereof Therefore itt is considered by the Court here this day to
witt the Eleventh day of March in the fourth yeare of the Dominion
of Charles Lord Baltemore &c Annoq Doni 1678 that the said
Richard Sweatnam recover against the said John Blomfield the
aforesaid debt of three thousand five hundred Sixty & one pounds
of tobacco And also five hundred & Sixty pounds of tobacco costs
