quantity of Six thousand One hundred Eighty nine pounds of good
sound Mrchnatable leafe tobacco in cask to be paid to the said Ben-
jamin Rozer his heyres Execrs Admrs or assignes in some convenient
place in Charles County att or before the tenth day of Octobr next
ensueing the date of the same bill. To the which paymt well & truely

to be Made the said George did binde himselfe his heyres Exrs &
Admrs firmly by those prsents Notwithstanding which the said
George Thompson though often thereunto required the said six
thousand one hundred Eighty nine pounds of tobacco according to
the tenour forme & effect of the same bill hath not paid nor satisfied,
but the same to pay hitherto hath denyed & still doth deny, where-
upon the said Benjamin saith he is damnified & hath losse to the
Value of tenn thousand pounds of tobacco & thereupon he bringeth
his suite
And the said George Thompson in his proper person cometh &
defendeth the force & injury when &c and saith that he cannot gain-
say the said action of the said Benjamin, for that he hath not paid
to the said Benjamin the said sume of Six thousand One hundred
Eighty nine pounds of tobacco in discharge of the said recited bill
or writeing obligatory, which to him he ought to haue paid accord-
ing to the forme & effect of the aforesaid bill Therefore itt is con-
sidered this day to witt the thirteenth day of March in the fourth
yeare of the Dominion of Charles Lord Baltemore &c Annoq Doni
1678 that the said Benjamin Rozer recover against the said Geo :
Thompson the aforesaid Suine of six thousand one hundred eighty
nine pounds of tobacco debt As also pounds
of tobacco costs of suite And the Defendt in mercy &ca

of John Clentens deceased were Summed to
Answer unto George Lewen of Poole Mrchant in
a plea that they render unto him ffive thousand

weight of Arronocoa tobacco which from him they unjustly detame
And whereupon the said George Lewen by William Crosse his
Attorney saith, that whereas the said John Clemens the Eighth day
of September one thousand six hundred seventy two by his certaine
bill obligatory Sealed with the Seale of him the said John Clemens
here in Court produced whose date is the day & yeare aforesaid, did
acknowledge himselfe indebted unto the said George Lewen ffive
thousand weight of Arranocoa tobacco of the brightest in cask,
which said five thousand of bright tobacco he did thereby oblige
himselfe his heyres Execrs Admrs & assignes firmly by those prsents
to pay unto the said George Lewen or his assignes within twenty
dayes after the arrivall of the Sea-Flower att this Province whither
the said Shipp was then bound Yet notwithstanding the said John
