beccah his wife Exx of John Brooke late of Cal-
vert County deceased were Attached to Answer
unto John & Thomas Dudleston of a plea of
trespasse upon the case

And whereupon the said John & Thomas
Dudlestone by Charles Boteler their Attorney complaine, that
whereas the said John Brooke in his life tyme Vizt upon the thir-
teenth day of October in the yeare of our Lord One thousand six
hundred seventy foure in consideracon of severall Goods & Mrchan-
dizes of them the said John & Thomas Dudlestone in hand received
amounting in the whole to the Sume of ffive hundred thirty & eight
pounds three shillings & tenn pence stert as by the Invoyce thereof
here in Court produced appeareth, the said John Brooke did assume
upon himselfe and to the said John & Thomas Dudlestone did faith-
fully promise that he the said John Brooke when thereunto required
would accompt with the said John & Thomas Dudlestone for the said
Goods and the produce thereof, & would pay unto them what Sume
or Sumes of tobacco soever he should produce or make of the Same
And the said John & Thomas in fact say, that trusting to the faith-
full promise and assumpcdn of him the said John Brooke made as
aforesaid did deliver unto him the said John Brooke as ffactor of
them the said John & Thomas Dudlestone a Cargo of Goods amount-
ing in the whole to the sume of ffive hundred thirty Eight pounds
sterling three shillings & tenn pence to be Sould disposed & ac-
compted for unto the said John & Thomas Dudlestone as aforesaid
Notwithstanding which the said John Brooke his said promise and
assumpcon not reguarding hath not accompted unto them for the
said Goods, nor hath not paid unto them for the produce of the
same any more then the Sume of foure hundred Sixty and three
pounds three shillings & tenn pence sterling in part of the aforesaid
