100 Provincial Court Proceedings, 1678/9.

fourth yeare of the Dominion of Charles Lord Baltemore &c Annoq
Doni 1678 cometh as well the said plaintiffe as the said Defendt by
their Attorneys aforesaid And the aforesaid John Quigley by his
said Attorney saith, that he did not assume & promise in manner &
forme as the said Marke Cordea above against him hath declared
And of this he putts himselfe upon the Countrey And the plaintiffe
also Therefore itt is comanded the Sheriffe of St Maryes County
that he cause to come here twelve &c by whom &c and who neither &c
to Recognize &c because as well &c Att which said thirteenth day
of March in the yeare aforesaid cometh the said parties by their
Attorneys aforesaid And the jurors impannelled being called like-
wise come to witt John Addison, Emanuel Ratcliffe, Tho: Potter,
John Watson, Charles Hea, Joseph Edloe, Wm Vaughan, Thomas
Courtney, Henry Smith, Christopher Benbridge, John Portwood &
Tho: Keyting who being elected tryed & sworne to say the truth [in

the] prmisses Upon their Oaths doe say that the said John Quigley
did not assume and promise in manner & forme as the said Marke
Cordea aboue against him hath declared Therefore itt is granted by
the Court here that the said Marke Cordea take nothing by his writt,
but be in mercy for his false claime thereupon prosecuted And the
said John Quigley may goe thereof without day &c And that the said
John Quigley recover against the said Marke Cordea the sume of
Eight hundred ninety seven pounds of tobacco for his costs & charges
by him about his defence in this behalfe laid out and expended, to
the said John Quigley by the discretion of the Justices here adjudged
And the said John Quigley may have thereof Execucon.
