Sheweth That whereas there was an Agremt betweene Mr Couell & Mr Batten for ye ualue of One hundd & six pownds, Seauen shillings & eleuen pence stert. wch ye sd Mr Batten was to make present paymt for in Tob att 2d per pownd. All wch wth a Case of drams att 200l the whole summe comes to 12967l of Tob in Cask. And hee only payd of it 9492k. And the Agreemt was That if ye sd Mr Batten should not make paymt of all ye Tob, wch ye sd summe should amount to, That then hee should returne soe much of the goods back againe in kind, as should pay for ye Tob, that should bee behind. Now soc it is that there is behind 34751 of Tob not payd, nor any other Con sideraeön gyuen. Neyther in deed had Mr Batten att yt time any more Tob, yt was good to pay. Whereuppon Mr Batten causeth Mr Couell to bee arrested in an accon of ye Case about a man serut, sold some yeares formerly by Mr Couell to Mr Batten. wch was nothing consistant to this Agreemt or summe of Tob. But only yt Mr Batten was pleased to make this an occasion for to bee a stop, yt hee might not make paymt of any more Tob att present. And the ship being ready to goe, the yeare being late, & his Seamen grow ing Sick, could not stay to answere Mr Battens suite, but appoynted mee his Attorney to answere in his behalf e. Wch I did. And accord ing to Mr Battens request, wch was on!y for security concerning that man servt formerly sold. I gaue him such security as hee 667 |
