returne to this Court. By the Court.

On the backside of the aforegoeing Order was written thus.
Whereas Wee the Cothissioners of the County of Kent have
received an Order from the Honble Provinciall Court dated the 12th
of 9ber 1673 and in pursuance of that Order Wee have examined
the buisnesse & the said Mr Eaton hath promised to pay the said
tenn thousand pounds of toba[cco] unto W Robert Dunn Guardian
of the Said Orphant of Capt Robert Vaughan.
Att a Court held for the County of Kent March the 23th 167 4/5
Wee the Cothissioners of this County understanding by Mr Robert
Dunn the Guardian of Wm Vaughan that the abovesaid tenn thou
sand pounds of tobacco is as yet not paid, Whereupon wee Ordered
that the said Mr Eaton should be suthoned to the next Orphants
Court which was accordingly done but the said Eaton did not then
appeare

Which being read & heard it is Ordered by the Court here that a scire
facias issue to the said Jeremiah Eaton to shew cause if any he have
why execut[ion] for the said sume of tenn thousand pounds of to
bacco should not issue agt him, returnable next Court.
Memorandum That this Present Court to wit the fourth day of p. 569
May in the 43th yeare of the Dominion of Caecilius &c Annoq Doth
1675 Came here into Court John Pawson by Robert Carvile his
Attorny and exhibiteth here unto Court his certaine bill against
Thomas Wynne Cryer of the same Court in a plea that he render
unto him two thousand five hundred pounds of tobacco which to him
he oweth & unjustly deteineth
And whereupon the Said John by Robert Carvile his Attorny
Saith that whereas the said Thomas Wynne the fourth day of June
in the yeare of Our Lord One thousand six hundred seventy foure
by his certaine writeing Obligatory Sealed with the Seale of him the
said Thomas and here in Court produced whose date is the same day
& yeare abovewritten did bind himself e his heirs executors and ad
ministrs to pay or cause to be paid unto the said John Pawson his
heirs executrs admrs or assignes the full and just quantity of two
thousand five hundred pounds of good sound bright & large tobacco
& caske convenient to be paid conveniently in Baltemore County Not
withstanding which the said Thomas the aforesaid summe of two
thousand five hundred pounds of tobacco to him the said John hath
not paid though he hath been often thereunto required but the same
