224 Provincial Court Proceedings, 1673/4. Liber M M 1669 John Balley had and obteined a Judgemt agt Raymond Staple- ford for the sume of six thowsand three hundred forty five pounds of Tobacco for wch Execution issued to the Sheriff of Caivert County which said Sheriff leavyed to the vallue of three thowsand six hundred and fifty pounds of Tobacco of the goods and Chattells of the said Raymond Staple ford was all that Could be found in his Baliwick, out of wch sd surñe was allowed the sd Sheriff five hundred pounds of Tobacco for ffees so that their Remaines yet unsatisfyed three thowsand Two hundred forty five pounds of Tobacco wth costs of suite It was therefore Comaunded to the said Sheriff that by good and law full men of his Baliwick he should make Knowne to the sd Raymond that he be before the sd Justices this day to show Cause if any he had why Execution should not issue forth against him for the said sume of 3245l Tob & 125l Tob costs of suite. At wch sd day to wit the Tenth day of ffebruary in the 42th yeare of the Dominion of Caecilius &c Annoq Domini 1673. Came the sd Raymond (the sd Sheriff having made Knowne to him as by the sd writ he was Comaunded) in his pp pson and no Cause did show satisfactory to the Court here why Execution should not issue agt him as aforesayd wherefore Ordered by the Court here that Execution issue agt the sd Raymond Stapleford for aswell the sd sume of 3245k Tob as also for the sume of 125l Tob Costs in all 33701 Tob accordingly. Philip Shapleigh & ux The Sheriff of Somerset County having agt Retorned a Cepi upon these Two writs & Richard Pattyneither of the Defendts appearing ordered The sameIthat in Each Cause the Sheriff be amerced agtforty shillings unless they appeare the next Samuell Jackson Cort by themselves in pson or Attorney. 160 Mr Walter Hall peticions this Court that Whereas upon the 11th day of Aprill 1672 John Balley of this County of St Maryes, was by this honoble Court Comitted prisoner into the Custody of the petr (being then under Sheriff of this County) and so Continued untill the 16th day of May next following, At wth time the petr did Rendr the sd Bailey with other prisoners up into the Custody of the new Sheriff Capt Luke Gardner by Indenture. But now the said Bailey being at liberty Refuseth to pay the petr the ffees of his Imprisonmt wch Comes to seaven hundred and Twenty pounds of Tobacco, al though allowed him by this Court in his bill of Charges at suite of Capt James Neale, wherefore the petr Craveth ordr agt the prsent Sheriff for the said ifees of 720l Tob, who ought in Right to have secured the same from the said Bailey before his Enlargemt or else |
