Provincial Court Proceedings, 1673.     III

       receipt thereof the said John Quigley doth hereby Promise to pay Liber M M
       or cause to paid unto the abouenamed partyes or their Order the
       sume of One Thowsand Two hundred & ffifty pownds of good
       sound mrchantable Tobacco in Casque to Be Punctually Delivered
       within Thirty dayes after the said shipps Arrival in Virginia without
       fraud or further Delay, for the Just & true performance of this
       Bargaine or Contract we seutally binde our selues heyres Executors
       & Adminrs in the sume of ffiue hundred pounds sterling to be Leavyed
       on the party that shall not per forme this Agreement. In witnesse
       hereof wee haue hereunto sett our hands & Seales the 23d day of
       November. in the 23d yeare of his Majesties Raigne. Anncxp

       It is agreed before Deliury that if any Dutyes
       are to be paid for the said wynes mr Quigley is to pay it

         Know all men by these prsents that wee John Maitby mrchant & p.46
       John Litchington Comandr of the good shipp Mary of London. Doe
       hereby Joyntly & seutally acknowledge our selues to owe & stand
       Justly indebted unto John Quigley of Virginia mrchant in the Just &
       full sume of ffive hundred pownds sterl. to be paid to the said
       John Quigley his heyres Executrs Adminrs or assignes at the tyme
       herein hereafter mentioned for the Just & true pformance herof
       we bynde our selues our heyres Executrs & Adminrs firmely by these
       prsents. in wittnesse hereof wee haue hereunto sett my hands and
       seales this 29th day of November in the 23d yeare of his Majestyes
       Raigne. Annoque Domini. 1671.
         The Condition of the aboue Obligacon is such that whereas there
       is a Contract bearing date the 23d instant signed and Deliuted betwixt
       the aboue bounden John Maltby and the said John Quigley for ffifty
       pypes of ffiall wynes to be Deliured to the said John Quigley or his
       order According to the Condicôn mencãned in the said Agreement
       without Altering the Voyages. but shall Justly pforme the same
       according to Covenant and Charter party without fraud that then
       this aboue Obligacon shall be Voyd else to Remayne in full force
