thousand Pounds of Tobacco the said Trustees or the Survivors
of them shall annually have Allowance in their Accounts with the
Creditors of the said John McPherson.

And be it further Enacted That in Case the said John McPherson
shall at some convenient Time after the Receipt of this Act not
exceeding five Days deliver up and surrender or cause to be delivered
up and surrender to the said Trustees or the Survivors of them all
his real and personal Estate either in Possession Reversion Remainder
or in Trust or in or unto which he hath any Claim or Title whatso-
ever and at the Time of such surrender take his Solemn Oath to the
Effect following (viz) "I John McPherson do solemnly swear that
the Lands Goods Debts and Effects which I have surrendered and
delivered to the said Josias Hawkins George Dent and Samuel Love
in Trust for the Use of my Creditors are the whole Estate both
real and personal of my own in possession or that I have any Title
to in the World (except the Interest or Share I have in the Cudbear
Works in Scotland and my necessary wearing Apparel and Library)
and that I have not directly or Indirectly sold leased or otherwise
conveyed disposed of or intrusted all or any Part of my Estate
thereby to defraud my Creditors or to secure the same or receive or
expect any Profit or Advantage thereof (so help Me God) And
in Case the said John McPherson shall within the said five Days by
Good and sufficient Deeds of Lease and Release or otherwise make
over and convey unto the said Josias Hawkins George Dent and
Samuel Love or the Survivors of them all his Share Interest and
Property in the Cudbear Works in Scotland and all his Estate and
Interest in that Kingdom or elsewhere for the Benefit of his Credit-
ors it shall and may be lawful for the Sheriff of the County aforesaid
after the End of the said five Days and he is hereby required to dis-
charge the said John McPherson and suffer him to go at large

And be it further Enacted That if the said John McPherson shall
be arrested or imprisoned on any Process sued out or any Judgment
or Decree obtained against him for any Debt Damages or Costs
contracted owing or growing due before the End of this Session
of Assembly the Court out of which such Process issued shall and
may discharge him on Motion; and if the said John McPherson shall
be arrested or imprisoned on any Process for the Recovery of any
Debt Damages or Costs contracted owing or growing due before
the End of this Session of Assembly the Court or Justice before

whom such Process shall be returned shall and may discharge the
Party arrested out of Custody on his common Appearance being
entered without any Special Bail Provided that the Discharge of the
said John McPherson shall not Acquit any other Person from such
Debt Damage or Cost or any Part thereof but that all such Persons
shall be answerable for the same in such manner as they were before
the passing this Act
