An Act to enable Mary Darnall an Infant to enter into and accept
of a Marriage Settlement and Agreement
Whereas Henry Darnall junior and Rachel his Wife and the
aforesaid Mary Darnall Daughter of the said Henry Darnall and
Rachel his Wife an Infant of the Age of nineteen Years and Robert
Darnall Uncle of the said Mary Darnall have by their humble Petition
to this General Assembly set forth That an advantageous Offer of
Marriage hath been made to the aforesaid Mary Darnall and the
Sum of three hundred pounds Sterling a Year is proposed to be
settled on the said Mary during her natural Life in Lieu and in Bar
of Dower and of the Right she might have to any Part of the
Personal Estate of her intended Husband which Settlement the
Petitioners approve of and are willing and desirous that the same
should be executed.
And whereas the said Petitioners are doubtful whether the said
Mary being an Infant within the Age of twenty one Years by her
Acceptance of such Settlement can bar herself of her Right of Dower
in the real Estate and of such Part of the Personal Estate of her
intended Husband as she might be intitled to by Law. By Reason
whereof the said intended Marriage is delayed. And have prayed
that An Act might be passed to impower the said Mary Darnall by
and with the Advice of her said Father Mother and Uncle to assent
to the said Marriage Settlement for Securing the said Jointure to
the said Mary and in Bar of her Right of Dower in the real Estate
and Share of the Personal Estate of her intended Husband which
she might be intitled to by Law. In Compliance therefore with the
Prayer of the said Petitioners this General Assembly have thought
fit to Enact
And be it enacted by the Right Honourable the Lord Proprietary
by and with the Advice and Consent of his Lordship's Governor
and the Upper and Lower Houses of Assembly and the Authority
of the Same That the said Mary Darnall may by and with the
Advice and Consent of her said Father Mother and Uncle enter into
and accept of any Marriage Contract Settlement or Agreement
whereby and on which there Shall be issuing and payable out of and
charged upon Sufficient Lands and Tenements to Answer the same
not Less than three hundred Pounds Sterling Yearly to the said
Mary Darnall during her Life after the Death of the Person with
whom she may intermarry in Lieu and Bar of Dower in her intended
Husband's real Estate and in Satisfaction and Bar of any Share of
the Personal Estate of her intended Husband which she might be
intitled to by Law according to the true Intent and Meaning of such
Marriage Contract Settlement or Agreement And that such Mar-
riage Settlement Contract and Agreement as aforesaid shall to all
Intents and Purpose bar and preclude the said Mary Darnall to De-
mand or claim Dower in the real Estate and any Share of the Per-
