Charles County Court Proceedings, 1666—1668. 93 defraud the same to him the Plaintife hath not according to the said Liber C Lumbrozo's promise, and Assumption paid, and delivered or in anie Manner for the same Satisfied but the same to him hitherto to pay and Deliver he hath alitogether Refused and yet refuseth Whereupon the Plaintife saith he is Damnified and hath Damage to the value of 2900 lb of tobaccoe and thereupon he brings his Suite. Whereupon the Plaintife in Confirmacon of his said Declaracon [p. 217] produceth the said Bond, and Award wch were as followeth (vizt) Knowe all Men by these presents That I John Lumbrozo doe hereby Bind my self e, my heires, Executors, Administrators, or Assignes to pay or Cause to be paid unto Thomas Alcocks his heires, Executors, Administrators, or Assignes the full and just Sume of tenne thousand pounds of tobaccoe, and Caske upon all Demand The Condicon of this obligacon is such tht if in Case the said Lumbrozo stand to the award of William Calvert Esq and Zachery Wade gent concerning a difference for the sd Lumbrozo's having in his Custody severall of the sd Alcocks goods taken out of his house when the said Alcocks wife, and Child was Murdered by the In- dians then the obligacon is void and of noe effect, otherwise to stand in full force, and virtue As witnesse this my hand the 16th of Novembr 1665. George Thompson Samuell Cressey Whereas Thomas Alcocks, and Jo: Lumbrozo Chose us William [p. 218] Calvert Esp and Zachery Wade gent to determine all busines between them, and have each to the other bound themselves in a Bond of tenn thousand pounds of tobaccoe wth Caske payable upon demand to stand to our Award Nowe Knowe ye tht wee doe Award That the said John Lumbrozo shall pay unto the said Thomas Alcocks the Suffie of Nine hundred pounds of tobaccoe, and Caske upon demand, and all such goods as he Receaved of the Indians apper- taining to the English he is to Deliver to the said Thomas Alcocks upon oath and this is our Award Witnesse our hands this 16th of November 1665 William Calvert Zacherie Wade Hereupon the said Thomas Alcocks had a Judgemt Confessed unto him by the said John Robinson for the sd 900 lb It is Therefore ordered That the sd John Robinson as Administra- tor of the sd John Lumbrozo Satisfie and pay unto the sd Tho: Alcocks the sd sume of 900 lb of tobaccoe.
