Beane Mr Joseph Harrison Tho: Alcocks Plaintife Jo: Robinson as Adminr of Jo: Lumbrozo Deft [p. 214] The Plaintife arresting the Defendt in his acon of the Case to the value of 900 lb of good Merchantable tobaccoe preferreth his Declaracon as followeth (vizt) To the Worple the Comissionrs of Charles Countie. The Plaintife Declares agt the Defendt in his aeon of the Case for that some time in the yeare of our Lord 1665 there happening a Certaine Matter of Difference between the Plaintife & John Lumbrozo by reason that the said Lumbrozo in his Life time re- ceaved into his Custodie severall goods belonging to the Plaintife which upon the late unhappie Murder of the Plaintifes wife, and Children by the Indians were taken out of the Plaintifes house, he the Plaintife and the said Lumbrozo did assume, and promise each the other, and likewise became Mutually Bound to each other in a penall Bond bearing date the 16th of November 1665 for payment of the Sume of tenne thousand pounds of tobaccoe That as well the Plaintife as the said Lumbrozo should for the ending of all Con- [p. 215] troversies and Debates between them stand to, abide, and Submit unto the award, arbitrement, determinacon, and Judgment of Wil- liam Calvert Esq, and Zachery Wade gent Nowe May it please your Worships the said Arbitrators William Calvert Esq and Zachery Wade gent taking upon them the Charge of the said Award & arbitremt and having heard, and weighed the Sayings and Alegacons of either of the said parties the Plaintife, and the said Lumbrozo did thereupon publish, and put in writing this their award, and Determinacon as in Manner and forme follow- eth (vizt) That the said John Lumbrozo should pay unto the Plaintife the sume of 900 lb of tobaccoe with Caske upon demand and all such goods as he Receaved of the Indians appertaining unto the English he should Deliver unto the Plaintife upon oath as by the said Award relacon being thereunto had may more plainly appeare But the said [p. 216] John Lumbrozo deceasing soone after the said award the Plaintife hath Required the Defendt as Administrator of the said Lumbrozo's estate, as aforesd to performe that part of the sd Award and Arbitre- ment whereby the said Lumbrozo became obliged to pay unto the Plaintife the said Sume of 900 lb of tobaccoe, and hath Demanded the same of the Defendt But the Defendt litle regarding the said promise, and assumption of the said Lumbrozo but plotting and fraudulentlie intending him the Plaintife of the said Sume of Nine hundred pounds of good sound tobaccoe and Caske to deceave, and |
