408 Charles County Court Proceedings, 1671—1674. Liber E the said Richard Fowke his heyres and ass ignes forever agt him the said Maddox his heyres & assignes, and against all and every pson and psons wtsoever lawfully claymeing by from or under him them or any of them and against all other psons wtsoever, (Excepting Major Thomas Brooks and Capt Luke Gardner theyre heyres and assignes) Shall and will warrt and forever defend by these prsents, And the Said Edward Maddox for himselfe his heyres Executrs & Administratrs doth Covenant promise grant and agree to and wth the said Fowke his heyres and assignes by these prsents tht the said Rich Fowke his heyres and assignes and every of them shall and may by force & virtue of these prsents from tyme to tyme and att all tymes forever hereafter lawfully peaceably and quiettly Have hold use occupy possess and enjoy the said Land and all Singular the before granted prmisses wth theyre and every of theyre rights membrs and appurtenances and receive the rents and proffitts thereof to his and theyre owne propper uses and behoofes wthout any manner of lett trouble or interrupcon of or by the Said Maddox his heyres Execu- tors administrators or assignes or any of them or of or by any other pson or psons wtsoever excepted onely as before excepted the Rents & Services wch from henceforth from tyme to tyme for and respect of the first menconed prmisses hereby Sold Shall grow due and pay- able to the cheife Lord or Lords the fee or fees thereof for and in respect of theyre Seignorye or Seignoryes excepted ailso and fore- prized and the Said Maddox doeth farther Covenant & promise that he the Said Edward Maddox his heyres Executrs & Adminrs Shall & will from tyme to tyme and all tymes hereafter wthin the Space of Seven yeares next ensueing the date hereof at the reasonable request and at the cost and charges In the Law onely the said Rich Fowke his heyres Executrs and Administrators or assignes make Sale convey and deliver Such farther assureance or assureances for the before bargained prmisses excepting onely as before excepted as the said Rich Fowke his heyres Executrs Adminrs or assignes or any of theyre Councell learned in the Law Shall him the Said Maddox his heyres Executrs or Administratrs or any of them thereunto require In witt- ness whereof the above said partyes have interchangeably Set theyre hands and Seales the day and yeare first above written Testibus Zachary Wade Edward Maddox (locus Thomas Hudlestone Sigilli) Rich: Fowke(locus Sigilli) John Owen acknowledgeth this ensueing Conveyance of Land in open Court to James Hayes & Philip Hoskins This Indenture made the Seventh day of Septembr 1671 Between John Owen of Charles County in the Province of Maryland Plantr of the one part and James Hayes and Philip Hoskins of the same County Plantrs of the other part Wittnesseth tht the said John Owen |
