Liber E and Eliza his wife Admrx of the goods and Chattells of Daniell
Johnson deceased Defendts the plaintiffe declares agt the Defendt p
his Att: Phil Symes for foure hundred pounds of tobacco, Will
Britton Sworne in Court and declares tht I knew Daniell Johnson to
bargaine wth Daniell Johnson for one barrell of beere for the wch
to pay foure hundred pds of tobacco, and to his knowledge Cox was
never satisfyed for the Same in the life tyme of the Johnson,
and farther Sayes not, whereupon the Worshipfull Comishoners
gave Judgmt agt the Deft wth costs of Suite
In a certaine matter of difference depending betweene Barnard
Hamy Plantiff and Ann Fowke Deft the Defendant not appeareing
the Comishrs thought fitt to referr it till the next Court
In a certaine matter of difference depending betweene Robert
Cossleton plantiff and Wilt Gater Defendant, they both appeareing
the Defendant craved an imparlance wch was granted
In a certaine matter of difference depending betweene Tho: Price
Plantiffe and Capt James Neale Defendant the plaintiff prferrs his
declaracon: And whereupon the Said Thomas Price by Sam: Cressy
his Attorney complaynes agt the Said Capt James Neale on the 29th
day of July in the 40th yeare of the Dominion of Caecilius &c, over
this Province of Maryland Annoq Dñi 1672, by force of armes
that is to Say theyre fists and wth a Stake on him the said Thomas
at the house of him the said Capt James Neale made an assault and
him beate wounded & evill intreated to the great damage and Injury
of him the Said Thomas, and agt the peace of the said Province,
whereupon he sayes he is damnefyed and hath loss to the value of
1500 lb of tobacco and thereupon he bringes his Suite
Gerrard Fitzgerrard Sworne in open Cort on the behalfe of the
plt who declares tht on the 29th of July that he was walkeing Capt
Neales fence and that he there saw James Neale the Sonn of the sd
Capt Neale, and Thomas Price fighteing, and the said James Neale
Junior called out wth a loud voyce for helpe, the Deft heareing him
came and wth a Stake Strucke him two or thre blowes and pushed
him of from his Sonne wh the same Stake &c
Mathew Burst Sworne in the behalf e of the Deft and declares tht
the same day Capt Neale and himselfe was walkeing neare the
place where James Neale and Thomas Price was, and heareing some
voyce, they went to the place and found it to be the James Neale
Junior and Tho: Price, and the said Price had pulled much hayre
from the head of the said James and farther sayes not
The Worshippfull Comishoners have ordred that a Venire facias
be entred — is done
A Jury impanelled at the request of Plaintiffe
