366 Charles County Court Proceedings, 1671—16 74. Liber E the Sd plts by a bill bearing the Same date payable the 10th day of october 1670 wth the Ensueing bill of Costs. To Atturnys Fees 60 To coming goeing & Attendance 90 150 For both which Execution was issued forth agt the bodys of the defts at the Suite of the Sd pits & directed to the Sheriff James Smallwood was Attached to answer Fra: Kilborne & Eliza his wife of a plea that he render unto them the Sume Two thousand two hundred thirty foure pounds of Tobaccoe. Whereupon the sd Plts Complained agt the Said Deft for the Said debt due to Dan: Johnson deed upon a bill under his hand & Seale bearing Date the 23th day of febry in the 39th yeare of the Dominion of Caecilius Annoq Domini 1670 & here in Court Produced, pay- able on the tenth day of october next Ensueing which the Sd Deft refused to pay whereupon the Court gave Judgement agt the Deft for the Said Two thousand two hundred thirty foure pounds of Tobaccoe wth this Ensueing bill of Costs Prferred by the pit: To Atturnys Fees 6o To goeing coming & attendance at Court 90 150 Whereas the tobaccoe due from peter Long to Francis Lamb was at the Suite of Benja Rozer attached in the hands of the Said Peter Long, the Said peter Long came & in open Court made oath that he did Stand indebted to the Said Francis Lamb only the Sume of Six hundred and two pounds of Tobaccoe wch by order of Court the Sd Long is Comanded to deteyne in his hands for the use of the Sd Benja Rozer. Kellam Magloghlin was attached to answer to Nich Pittoway of a plea that he render to him the Sume of fourteene hundred Sixty & three pounds of Tobaccoe & Caske wch he oweth & unjustly detein- eth &c. And the Sd Pittoway by his Atturney Bennett Marshiguay Comrn plaineth agst the Said Kellam Magloghlin as Admr of the goods & Chattells of James Lindsey deed for the Said Sume due from James Lendsey by bill bearing date the 16th of May in the 38th yeare of the Dominion of Caecilius &c Annoq Dni 1670 to be paid on the tenth day of october next Ensueing &c And the Said Kellam alleadged that in the writt to the Sheriff directed he was not nominated as Admr of the Estate of mr James Lindsey but in his owne pper name & person And further that he |
