Charles County Court Proceedings, 16 71—16 74. 365 In a Certain Matter of difference depending in Court between LiberE Benja whichcott by his Atturney Math Hill plaintiff & Robt Cady deft [fol. 55] in a plea of trespas on the Case. The Deft having had but Short time to ptcure his Evidence for proving how much he hath Satisfyed the plt craveth an imparlance was granted. Thomas warner being attached to answer to Benja Rozer of a plea of trespas on the Case craved an imparlance which was granted by the Consent of the plt likewise. william & Thomas Harguesse were attached to answer to Francis Kilborn & Eliza his wife Administratrix of the goods & Chattells of Daniel Johnson deed of a plea that they render unto them the Sume of two thousand pounds of tobaccoe &c. And whereupon the plts complaine agt the defts for that whereas the Sd Defts by a certain writing under their hands & Seales bearing date the 24th day of September in the 34th yeare of the Dominion of Caecilius &c Annop Domini 1669 became bound unto the above named Dan: Johnson to pay unto him the Sume of Two thousand pounds of tobaccoe on the 10th day of october 1671 yet the Said Defts although often thereto required the Said 2000 lb tobaccoe have not payd but doe altogether refuse to pay the Same whereupon the ptts Say they are Damnified & have Loss to the vallew of 2000 lb tobaccoe & thereon they bring thr Sute And they prduced this Ensueing bill. This bill bindeth us william Harguesse & Tho: Harguesse to pay or Cause to be payd to Daniel Johnson his heires or assignes the Sume of Two thousand pounds of tobaccoe to be payd to the Said Daniell his heires assignes or Certain atturney conveniently in Charles County on the tenth day of october to be in the yeare of our Lord 1671 To the which paymt well & truly to be made we bind us our heires Executors & Admrs Joyntly & Severally by these pnts In wittnes whereof we have hereunto Sett our hands & Seales this 24th of Septembr 1669 will X Harguesse (locus Wittnes his marke sigilli) Charles Boteler Tho: X Harguesse (locus Johnathan Samwayes his marke sigilli) whereupon the Court gave Judgemt agt the Defts for the Sume of two thousand pounds of tobaccoe wth this Ensueing bill of Costs Pferred by the pit: To Atturnys Fees 6o To coming goeing & attendance 90 150 Likewise the Court gave Judgemt agt the Defts for the Sume of three thousand pounds of tobaccoe due from the Said Defts to them |
