Charles County Court Proceedings, 1668—1670. 263 killable provided alwaies the aforesd Minister shall be bound to re- Liber D deliver or cause to be delivered back againe into the hands of the overseers hereafter mentioned att death or his removeall upon any other occasion the same number of tenn female Cattle of the age of three years or upwards or the full & true value of thm as also in case the Minister doe not accept of the Grant above specified not [p.4] judging it his advantage tht thn the sd overseers shall have full pow'r to dispose of thm to the use & benefitt of the poore inhabi- tants according to the tenour of the Grant hereafter specified The remainder of the aforesd number of Cattle whether male or female I doe by these prsnts give grant & Confirme to the use & benefitt of the poore or indigent Inhabitants whether householders or others of the same County wthin the limits & bounds herein described tht is to say liveing & being scituate betwixt the two rivers of Wico- comoco & Potomack from John Coates now dwelling plantation on Wicocomoco side & from Thomas Bakers now dwelling plantation on Potomack side downe wards the neck as farr as the point Commonly called Cobe-point to have & to hold the Said Cattle to their benefitt [p.5] & use according to the tenor hereafter mentioned tht is to say tht the sd indigent householders or inhabitants shall according to dis- cretion of the aftermentioned overseers have the remainder of the female Cattle from time to time distributed amonst them to enjoy the benefitt of their milk they being bound to make Good the Cow or Cow's dd to thm fore the forementioned use & upon any demand of the overseers to redeliver the sd Cow or Cowes wth the Calves or increase of the same for the Continuance & prservation of the Stock granting likewise tht it shall be in the pow'r of the overseers from time to time yearely to kill or cause to be killed any of the sd Cattle as they shall become fatt & killable & to distribute the flesh of the sd Cattle amonst the said Indigent inhabitants or to dispose [p.6] of it to any other pious & good uses as they shall Judge meet And for the due pformance of the prmises I doe desire & request the prsnt minister Mr Mathew Hill Mr Humph. Warren of Hattons Point & Mr John Bowles att Pickywaxen to take upon thmselves the office & trust of overseers to se to the true performance of the prmises ac- cording to the true intent & meaning thereoff whome I doe by these prints appoint ordaine & Authorize overseers for the uses and intents ‘bove specified & in case any of the sd overseers shall faile either by death or removall from the place above limitted or by Voluntary quitting of their trust tht thn it shall be in the pow'r of the major parte of the inhabitãts aforesd being housholders from time to [p. 7] time to elect & choose others of thmselves in their stead to supply the place of overseers to the intents & purposes above mentioned, whome, as A testimony of my respect to them for their Care in the prmises I doe hereby impow'r to kill & take to thmselves the benefitt of one fatt steere yearly Provided alwaies tht it shall & may be lawfull for the aforesd William att any time or times hereafter |
