Charles County Court Proceedings, 1668—1670. 259 Hereupon the Deft begged he might have the benefitt of his writt Liber D of priviledge, & they not proceeding according to law & priviledges allowed the Clearke of the Court he craved a nonsuite agt the plts wch was granted him. John Hatch & Robt Rowland Admtrs of the goods & Chattles & Creditts of Francis Bullock decd Plts Henry Bonner Deft And whereupon the said John & Robert Complaineth against the [p. 162] said Henry For that whereas the said Henry oweth the 27 day of Octor in the yeare of our Lord 1669 or thereabouts had & recd from the said Francis Bullock severall goods & Marchantdizes amting to the Valew of three hundred fifty nine pounds of tobaccoe as by a particular Acct here in Court by the said John Hatch & Robert Row- land produced att large may appeare in Consideracon whereof the sd Henry did then Assume upon himself & to the sd Francis did faithfully promise tht he the said Henry the sd sume of 359 lb of tob wn thereunto required to the sd Francis would well & truly satisfy & pay yet never the less the sd Henry his sd promise & Assumpcon little regarding the sd sume of 359 lb of tob hath not pd neither to the said Francis dureing his life time nor to the sd John & Robert since his Death but doth altogether refuse to pay the same whereby the sd John & Robert have Loss to Valew of five hundred pds of tob & thereupon they bring their suite Whereupon the Deft Craved a nonsuite (agt John Hatch & Robert [p. 163] Rowlands they not proceeding according to the priviledges allowed the Clarke of the Court) which was granted to the sd Deft. Edmd Taylor p his Attuf John Tankard came & appeared to prose- cute the suite by him Commenced agt Arch. Wahab & Jane his Wife Admtrs of the Goods & Chattles of Alexdr Simpson Plt Arch: Wahab & Jane his Defts came also & appeared by their Attur Rich: Boughto to defd the suite comenced agt them by Edmd Taylor. Edmd Taylor of Charls County planter Complaineth agt Arch: Wahab of the same planter & Jane his Wife in an Acc of trespass upon the Case for tht (viz) whereas Alexander Simpson lately de- ceased stood indebted to the plt four hundred pounds of tob in Leiue of his full share of the Crop made att the Said Simpsons house the last yeare which said sume the said Alexander never pd in his life time nor the sd Jane since the decs of the said Alexander although often thereunto requested & therefore hee pray Judgemt And whereupon Richd Boughton Attur for the Defts in barrs of [p. 164] the Declaracon of the Plts saith tht for tht neither the Deft nor his Wife are mentioned to be Admtrs Admtrix in the Plts Declaracon which as he Conceivs they ought to be therefore he humbly craves a Non- suite which was denied him |
