258 Charles County Court Proceedings, 1668—1670. LiberD dred forty one pounds of tobaccoe the sd John Hitchinson in his life time did assume upon him self and to the sd Robert did faith- [p. 159] fully promise to pay not standing the said John Hitchinson in his Life time the said sume of 841 lb of tobaccoe nor the sd John Allen to whome Administracon of all and: Singualar the Goods & Chattles of the said Hitchinson were Committed since his death hath not satisfied though often thereunto required but doth altogether refuse to pay the same to the great Damage of him the said Robert where- upon he saith he hath loss to the Valew of twelve hundred pounds of tob & thereupon he bringeth his suite. Whereupon this ensueing bill was produced Mr Sly Sr pray send me by this bearer Mr John Cooper this box of sugar and charge it to his Acct who is yors to Comand June the 5 1668 John Hitchinson Pray if he hath occasion for any thing else let him have & charge it to my Accompt Recd this sixth of June 1668 of Robert Sly one quarter Cask of wine & sixty one pounds of sugar being both to the Valew of seaven hundred & fourteene lb of tob & Cask upon the Acct of Mr John Hitchinson as witness my hand John Cooper [p. 160] Recd of Mr Robert Sly forty two pounds of Biscake & two paire of tanned Leather Gloves & fifeteene skeans of silke I say recd p me this 3rd of June 1668 John Hitchinson Whereupon It was ordered the plt should have judgmt granted him agt the Estate of W John Allen in the hands of Mr Benja: Rozer for eight hundred forty one pounds of tobacco & Caske Costs and Charges of suite. John Hatch & Robt Rowland Admtrs of Francis Bullock Plts Henry Bonner Deft in an acc of Debt. Whereupon the sd John and Robert Complaineth against the said Henry for that whereas the said Henry by A Certaine obligation under his hand and seale beareing date the twenty seventh day of Aprill in the yeare of our Lord 1669 did become bound unto the said Francis Bullock in the sume of two thousand three hundred [p. 161] poundes of tobaccoe and Cask to be paid the tenth day of October in the same yeare as by the said writeing here in Court by the said John Hatch and Robert Rowland produced may more att large appeare yet never the less the sd Henry his said obligacon little re- garding the said sume of 2300 lb of tob hath not paid neither to the said Francis Bullock in his life time nor to the sd John Hatch & Robert Rowland since his death but doth altogether refuse to pay the same, whereupon the said John & Robert say they are damnified & have Loss to the Valew of 2900 lb of tob & thereupon they bring their Suite. |
